  • Hi just looking some advice on obtaining PPI information from Egg. (apologies if I have posted in wrong place).

    I had a loan with Egg which was paid off in or around August 2004. Unfortunately I no longer have any documentation to confirm if I had PPI. I had wrote to Egg enclosing £1 cheque and requested a copy of my credit agreement however they replied to me saying

    "as the account you refer to is now closed I have to inform you that Egg are under no obligation to comply with a request for a copy of the executed agreement under the Consumer Credit Act as we no longer have a contractural relationship relating to this account, nor are we seeking to enforce any agreement on the account. The right to be provided with this information from Egg Banking plc ended with the closure of the account".

    Is this correct? I believed that they had a duty to provide me with the agreement. As previously advised I first wanted to check if I had a PPI.

    Any help on the subject would be greatly appreciated.
  • That sounds like the excuse I had from Tesco (see post above). The account is closed, we don't need to tell you anything. Especially if you may do us for a PPI refund!

    They are correct. When the debt is repaid/account closed the requirements of the consumer credit act end and you cannot use S77-79 any more.

    Unfortunately (for you both) Tesco and EGG are correct. You cannot request Terms and Conditions for accounts which are no longer active.

    You both need to read the MSE advice article more carefully and send £10 for a Subject Access Request which will provide all details your lenders have on file for you for at least six years and (sometimes) more.
    They have 40 days to respond.

  • ok guys a little help to start me off if you dont mind?
    i was a young guy when i took my loan with bank of scotland (halifax) and did not know what i was really doing. i know i will have to send them a letter but in my paperwork which i had sent out it mentions:

    amount of credit (the insurance loan)

    and has an amount beside it. does this mean ppi or not? i will be sending a letter anyways but just a little info would be great.

    I have an account with a large catalogue company. I have gone into arrears due to illness (I am making minimum payments). I noticed the account had insurance (I had no recall of agreeing -online sign up). They have refused to pay out because say I had illness before insurance so I am not covered (I would not have taken out insurance if this was the case). They have sent me copy of policy on request but not copy of my signature. Can I claim back money paid for policy because 1. I did not know I was paying for insurance and 2. Whether I had known it is unsuitable for the loan? No one, not even my GP/Consultant knew my illness would progress to permanent disability.

    This is PPI, if you have valid reasons for mis sell, put the claim in.
    Send a copy of the agreement that you have as well.

    Put the claim in, pre existing medical condition is one reason for mis sell that you can use.
  • Hi Amersall. Have you any opinion please on my questions relating to Barclaycard being 'unable to help' with my Egg card ppi request? Or my First National Tricity Finance query? Both detailed in my first ever post (number 6237) a couple of steps above. Thanks

    Hi, the FNTF may be a no go due to the year, you could put a claim into the company you purchased the goods from and see what they come back with.
    As the card is still running you must get statements, do these show PPI being applied?.
    As you have the card number, put a Sar request into Barclays, ask for all info they hold on you and not just statements, give them 40 days to respond.
