    My Farther recently passed away. I have found paperwork relating to a card protection plan bought from CPP and i wondered if i would be able to claim on his behalf?

    Capital One invite you to check with them to keep their actual complaints down. It's up to you whether you actually take them up on their offer, but there is no reason at all to doubt that their response will be anything other than truthful. Capital One have the lowest success rate for FOS referrals (only 11% are overturned).

    Thanks for your response. With that in mind I suppose it's a good way of determining whether my sister was mis-sold PPI. I do wonder how these things are proved though.

    By FOS referrals, do you mean that people are knocked back by the credit company and then go the ombudsman to appeal? And Capital One often win these appeals?

    Correct, only 11% are overturned by the Ombudsman due mainly to well kept audit trails.

  • Hi all, been looking into reclaiming my ppi on credit cards that I have had, i have encountered a problem with RBS as the cards are over 6 years old and I have lost all of the information regarding them apart from a account number for one of the two cards. I have sent a requesting my terms and conditions but they keep sending me back the same thing in the post " section 78 can only deal with active agreements if. The account is repaid we are not obliged to send documents under section 78" with this on the end please don't quote section 78 if you are trying to obtain your credit card no for ppi purposes. Any ideas what I can do seen to hit a brick wall with this now. I'm not sure if I had ppi on either of the accounts to be honest? Also does anyone know How to find out details of finance agreements bought 2 x items at pc world over 8-9 years ago? Sorry sounds useless I know but I'm a chucker!.

    It is my first time using this forum and I hope that you can help me. Ive very new to this, thanks for reading.

    I have been given an offer of £670.37 and ive been told this is to cover my PPI and interest. However when checking my payments I see that I Paid £633.24 this agreement was back in April 2006 has the interest been calculated right? or should I be expecting more from that
    £36.76 in interest in 7 Years Im not sure? can anyone offer any insight?

    If there is a template letter that i need to send in relation a link to such letter would be greatly appriciated.

  • Hi. Completely new to this so not sure if I am doing it right. I have had a credit card for at least 10yrs with HSBC. At the time of taking it out I was self employed. 4 yrs ago I started working for a company but still was self employed with my main trade. I recently wrote to HSC for my info an said that I think I mis sold ppi as I was self employed. They ave just wrote back to me with an annual review if ppi (never had one of these before) an that they have my employment status as 'part time' which they say indicates I worked less that 16 hrs per wk and therefore would not be eligible to make a claim. They are saying that they assume their current record of employment status is out of date and want to up date their records. I don't ever remember saying I ever worked less that 16hrs as I never have done. I wil ring them but wondered if any one else has had the same problem and how it got sorted. Thank u.

    As the guide here states, S78 only applies to open accounts where this is still a debt. You cannot use that method for closed accounts.

    You dont actually need the agreements to make a PPI complaint. That is a myth. It tends to be used only for people who dont know if they had PPI or not. It isnt reliable on cards either as most PPI on cards is added post sale and wouldnt appear on the agreement.

    If you need to know if you had it then ask them directly.

    If it isn't a goodwill offer, your redress should have been calculated as [for loans] the amount of PPI paid, the interest associated with that if it was added to the loan, and then 8% simple interest on top.

    For credit cards, it's the ppi paid, an interest calculation depending on whether your card would have been paid off earlier if ppi hadnt been added and 8% simple interest.

    If this is a goodwill payment, i.e. your complaint has not been upheld, then the rules don't apply and they can offer what they like.

    If you have proof you paid more, then send it to them. Or if you believe they have forgotten to include anything, write them a letter. There's no template.
