Thank you for your quick reply. I dont have any paperwork but I know that the salesperson told me there was a life element included in the policy and my son who took out his policy with Abbey at more or less the same time was told the same thing.
The gentleman did say at the time that I could take out a more comprehensive life insurance policy but that would be more expensive. When I told him I could not afford to take out another policy as well as the payment protection it was then he said that there was a life insurance element included in the policy.
I cannot believe that we are the only people given this information

hi, this is my very first post on any forum so i apologies for any mistakes upfront.
im in need of some advice please, my husband and i decided to make a complaint about being miss-sold mortgage ppi back in 1996.
we were very young (aged 18 & 22) when we took out our mortgage with the hallifax, we were told that we had to come back the following day to speak to a lady and sort out our insurance. we were told that we had to have the insurance in order to get the mortgage.
we told the insurance lady that my husband was in a job where he had full sick pay for 6 months and we showed her his job for life agreement from his place of work. we were told what insurances were suitable for us and what we needed to have and being young we trusted her and signed the paperwork.
we now believe we didn't need mppi and as we were not informed that it was optional we should not have been sold it.
we called the ppi complaints department 7 weeks ago and now today i have just recieved a letter to say our complaint has not been upheld as they have found no sufficiant evidence to agree with our alligation.
so now im wondering what do? were we miss-sold?
  • Hi. I am new to this forum but not to the website. I used the advice and the forms available on the website to submit my claim to MBNA back in October. I received a letter to say they would deal with the claim in 28 days. When I heard nothing in that period I called them and they said that they had requested other information but I had not received any letters requesting this information. He then took the information over the phone and said that the claim had been closed and he would now re-open it. I received the standard letter again saying that they would deal with it in 28 days. Then I received a letter with a copy of the questionnaire from the FOS and was told to complete this and return it for a full investigation. I had already completed this questionnaire for the first part of the complaint so I called MBNA today to ask whether I should submit this again and they told me that they have sent a letter in the post refusing my claim. They have told me the reason is that I ticked the box for PPI on my application form. Is there anything I can do now or is this the end of the PPI claim????

    Hi

I have an account which included PPI, but is now closed. I used the sample letter for CLOSED accounts, but got a response back saying "The Consumer Credit Act is for active agreements and therefore we are under no obligation to provide you with the requested documents as your obligations to us under the agreement have ended".

Notwithstanding the fact that I think they mean their obligations to me, checked and the OPEN and CLOSED templates are the same!

Can someone point me at a template for closed accounts? They still owe me the mis-sold PPI, but I need to get the old statements and a copy of the old agreement.

    Many thanks

    Simon

  • Hi,

    Sorry if I ramble.

I recently received a letter and a questionnaire from HSBC completely out of the blue saying 'records show that I purchased PPI on a personal loan I took out with them'. I did indeed take a loan out many years ago but I don't have records of my account numbers etc due to how ago it was. I have never thought of claiming aas it just didn't register with me. I do remember they pushed me to take out the PPI though.

They've sent a questionnaire for me to fill out and return to them and then they will come back to me within 8 weeks with a response.

The questions in the form as fairly basic and they don't ask for my loan details. At the top of the form there is obviously my name and a CIN number which I assume relates to the loan I took out?

    They ask questions like...

'Did you have any other means of making your repayments if you were unable to work through sickness accident or unemployment?'
'Was PPI sold as a compulsory part of the loan' if yes give details...
'At the time you took out the loan did you expect to borrow extra money before the loan was repaid?'

I just want to make sure check I fill this form out properly to ensure the best chance of getting some sort of compensation.

Any help would be really appreciated.

    Thanks
  • Hi I'm new to this but would appreciate some advice please. I've put a ppi claim in to Lloyds stating it was missold as I get paid a years wage if off sick plus I had pre-existing medical condition when it was taken out - but none of these were questionned at the time.

I've now had a call from them asking me for more information e.g. employee benefits that I would get from work - redundancy etc. Should I give them this information or refuse, as I'm thinking this should have been asked when taking out the ppi and if they don't have it then it shows that they didn't ask the right questions and it was mis-sold. I know they're trying to find a loop hole to get out of paying what's owed. I'm slightly confused as to what to do!

Oh, and just to confirm I would get the basic redundancy packet (which isn't much).

    Thanks

If you refuse to give them the evidence to support your comments then they can reject your complaint. They are allowed to ask for this. They are not asking now to fill missing gaps. They are asking to see if what you are saying is correct and you are not making it up (many people do).

Only if neither of you planned on dying.

Could either of you have afforded to pay the mortgage off entirely if one of you died?

It also depends on what PPI you were paying. Critical Illness/Unemployment/life insurance?
