PPI Reclaiming Discussion Part 5

In 2002 my father was offered a credit card by one of those stands you see in airports. At the time he had credit cards and didn't need another one. However, he knew that I had recently been turned down for a card, and took the card from MBNA on the understanding that the card could be issued in my name, and that I would be the primary user of that card. So essentially he underwrote the use of that card. Although the card had my name on it, the statements were being issued in his name. However, I was the one sorting out the balance etc.
I did a balance transfer in 2005 once I'd been able to get a card of my own. My question is this: can I contact MBNA (now apparently Bank of America) and raise a PPI claim against them? My father passed away in 2006 so I wouldn't be able to get the claim raised in his name. Do I have any sort of case?0 -

That means it was his account with you as an additional card holder. My question is this: can I contact MBNA (now apparently Bank of America) and raise a PPI claim against them? My father passed away in 2006 so I wouldn't be able to get the claim raised in his name. Do I have any sort of case?
You were not the account holder. He was. The executor of the estate can raise a complaint on his behalf. Although most card providers only keep 6 years worth of statements. So, good chance no records exist any more. Plus, you havent mentioned if there was any wrong doing.I am an Independent Financial Adviser (IFA). Being honest, I don't know if there WAS any wrongdoing. I may still have the statements in my mother's house (I was really anal about these things back then). The thing is, the estate has long since been settled, but I'm wondering if my mother (same address) would stand any better a chance.0 -
Dear All
I am new to these forums so apologies if this has been asked before but I am not sure whether I have had PPI in the past for two loans I had. I have contacted the loan providers and they have said i did not have it-I have no paperwork so prior to requesting the paperwork can I take their word for it? Are they now playing ball and not mis-informing people.
Maybe I am a bit naive but I would hope they are not telling people porkies?
Many thanks0 -
Thanks for your reply above. First the good news, I've just received £5700 from NatWest for PPI on a credit card, had been told on the phone it was £4500 so that's great news. All without ANY documentation, PPI policy numbers or old statements, amazing.
Your comments on the Tricity thing are what I expected, it is very long ago.
The Barclaycard (formerly an Egg card) is still active but I stopped the PPI premiums perhaps eight years ago. They say that they 'are unable to proceed further' without me providing documentation such as old statements that show PPI being deducted. It was an Egg online credit card anyway, I stupidly never printed out the monthly statements. I don't really believe them though. How can RBS pay out £5700 on NatWest card and £1300 on a Mint card without documentation, it was just as long ago in their case. I think I'm lucky that RBS have paid up at all! Thanks again to everyone on here for inspiring me to ask the !!!!!!s0 -

As highlighted in your post above, you ceased paying PPI on this card eight years ago. Banks typically keep records for only around six years and credit card PPI is only paid when there is a balance on the card. The Bank are telling you they no longer have records of any PPI you may have paid. If (as you say) you don't believe them, you can write a Subject Access Request (SAR) which will oblige them to send all details they have kept on file for you. This will be at least six years, but may be more if they have any older records.
It's your choice whether you wish to gamble a further £10 in pursuit of Egg.0 -
Hello, may I get back PPi payments started before January 2005, even though the company is no longer in business?
The company is "Network Data".
How or where can I get back payments, FSCS will only deal with companies since January 2005.
Thank you, Wayne.0 -

Yes, FSCS contacted me back to say they cannot help as the policy began before 2005. However the company is no longer trading.

EDIT
It might be possible for you to pursue the insurer (if you can find out who that was); but it's a long shot and I've yet to see anyone report success with this.
