Hi there,
I took out a graduate loan with HSBC in 2008. I have started making a claim on the basis that I consider the PPI was mis-sold. Today I have had my final response from HSBC stating that they have reviewed the paperwork from my meeting and do not believe that it was mis-sold. I intend to now take the claim to the Financial Ombudsman as I have nothing to lose, but I'm just wondering if anyone else has had any experience with HSBC and if they were successful or not? My concern is that there are records of advise given at the time the PPI was sold which both I and HSBC have copies of and while these are accurate in what they do say, they omit a certain amount of detail that would support my complaint.
At the time took out the loan I had a meeting with an Advisor (prior to being accepted for the loan, but having discussed borrowing needs and the loan amount). During this meeting the Advisor intimated that I was more likely to be accept if I took out PPI. She gave various advise on the type of cover I might need but at no point did she ask if I already received sick pay from my employer (as it happens I didn't but surely she should have asked the question). I also mentioned that my partner would be able to cover the cost of repayments in the event of sickness or unemployment but this was deemed irrelevant as we were not married at the time. None of these facts are included in the records and therefore I'm wonder if the Financial Ombudsman will consider them as part of my claim?
As I say I intend to pursue the complaint anyway but would be grateful if anyone has any insight from similar circumstances. I have looked on the successes and failures thread but couldn't find details of similar circumstances.
In case it helps the PPI was not added to the loan but was sold as an additional product and has now been cancelled.

I'm new to this and after some advice.
Have any of you experienced any issues with the banks back dating letters, which they claim they sent you?
I visited my bank in September 2012, to start my ppi complaint. After receiving no acknowledgement I visited my local branch again to see if they could tell me if it had been logged. They confirmed that it had and that I should receive an acknowledgement letter, confirming the next steps, in the next few weeks as there is currently a back log. A couple of weeks went by, and still nothing! This time I called them and spoke to a personal banker who confirmed that they would send out some information for me to complete. Two more weeks pass and still nothing. After reading posts on this forum I decided to send them some information which I had managed to find which outlined the policy numbers and premium amount, including the ppi questionnaire form. This was all sent to them recorded, and I received confirmation that it had been received. That was all sent before christmas. Two more weeks later still nothing so I write again asking them to acknowledge my complaint within 5 days as stated on their website.
Today I have received a letter dated 16 jan although the date printed on the footer of the letter is dated 17 jan???? this letter includes a copy of a letter dated the same date as when I first logged my complaint (10 sept), which i have never received, stating that they had carried out a full investigation and that they haven't been able to ascertain that I held any policy???? It also states that I have 6 months from the date of the letter to take my complaint to the FOS.
Nearly 5 months has passed and I have not heard or received anything and now after two letters, two phone calls and two visits to my branch a letter appears giving me only a few weeks to refer it to the FOS. It does not refer to any of the information which I sent them at Christmas and now I'm beginning to feel slightly confused on what to do?
Do you think they do fully investigate your case?
do you think that they back date letters to suit deadlines and cut off dates?, leaving you not much time to take it further.
According to their records, and letter, they managed to fully investigate my case and reply to me on the same day in which I logged the complaint, is that possible and does that reflect a full investigation?

i made a claim with hsbc, the claim was upheld and a week before christmas i received a form to sign to accept their offer, there was no timeline saying when it would be paid. any ideas how long this normally takes as not heard nothing more back0

Unlikely as most bank systems keep copies of the letters on file and they are listed in an audit trail.Today I have received a letter dated 16 jan although the date printed on the footer of the letter is dated 17 jan????
Nothing wrong with that. It means it was prepared on the 16th Jane and printed a day later (perhaps overnight).Do you think they do fully investigate your case?

Many complaints you could turn around in about an hour. Especially the weak ones (unprovable allegations etc). You dont say what your complaint was about. My bf just received at letter from Yorkshire bank saying they'll pay him £1950 back
it's only taken a year and half!! Nice when your not expecting it

Hi all - new to all this, advice needed as nothing fits my case !
I bought car on hire purchase Nov 97 was self employed, seller told me need ppi or will not be accepted, car company no longer trading BUT I have complete documentation including every bank statement which all clearly show paid over £1600 for ppi originally GEP Capital Finance, since taken over by Santander - who deny all knowledge of this agreement (sent letter and reply says can not find any information as all destroyed to comply with the data protection act)
Spoke to FSA they asked who underwritten the loan - I do not know, what should I do - can the FSA help ? is the FSA the right body to write to ? Any help would be very welcome as I am not sure what to do next ! Many thanks0 -
No one can help you with this because there is no one to complain to.
You complain to the company that sold you the insurance. the company that sold it to you is dissolved. It is also pre-regulation when the firm sold it to you [January 2005] so your complaint cannot be referrred to the FSCS.
It is also pre-regulation for the company involved even if it hadn't closed down.Non me fac calcitrare tuum culi0 -
Hi Taff, thanks for the reply, however I am still going to try ! I have full and complete documentation and have found the company who were the underwriters - I have just posted more information and will be contacting FSA again Monday28th as when I spoke to them last week they said without the underwriters details I would struggle ! Iam struggling - but sometimes it is best NOT to just roll over and give up, I appreciate what you say but once I get an idea/cause I cannot let it go - call me stupid but I can not let this go !
It is no longer about the money (now there is a statement) it is now about "give it back to em"
