Hi I have bank statements showing monthly payments for abbey cc 1996-2001 but it does not show ppi payment.the only document I have is from mbna when they took over card in 2001 saying that there was ppc on card.
What I don't understand is, you have statements from Santander showing no PPI but MBNA have said there was?.0 -

I have started the process and got the t&c's from moorgate.
I am now at the stage of posting the consumer questionnaire, but should I post it to egg or moorgate?

What years were these taken out and are they now closed?.
Send a Sar request to all 3, this will cost you £30 though as you pay £10 per bank, depending on the years these were paid off they may not hold any info even with a Sar request.
Do you have info at all? try your credit report if these were paid off in the past 6 years , the last 4 digits of the account numbers should be there, you can use these.0 -

Yes you can, you need to show the death certificate and probate details, ring the bank and ask what you need to do to make the claims.
One thing I am not sure about is the joint loans, as you have co signed for these and a claim is made for the PPI, if the loan is still running, you may have to repay this at the payment and rest of term of the loan, you get the PPI back that was paid to date with the interest, if you claim on the death benefit then the loan is cleared entirely, it may be that you may wish to clear these loans if they are still running and the balances are high, it may be worth more than the PPI claim.
I am not sure how this would work to be honest, this is just my logic.0 -

You had no PPI as if you had, it would show on the statements so you have no claim for the PPI mis sell.
Put the claim for mis sell into MBNA, if they uphold then they will send the complaint to Santander to pay the rest.

the bank statements are current account statements and although they show payments to abbey cc 1996-2001 they do not give a break down so there is no definate way to show ppi
I did send a questionnaire to mbna and they were fantastic and settled from 2001 to date. They did send to Santander to look at the period before this but Santander state they did not receive any documents. When I rang mbna they said that they were having problems with Santander and they would not liaise with them in any way to get this dealt with. Hence I decided to send off details myself
The only way I know there was ppi at 2001 when mbna took over was they had a computer printout showing details that were entered onto their system when they took over and it was detailed that there was ppc on card when it was abbey
So there was more than likely some ppi but I have no other solid proof so without this is there any chance of it going to fos and being upheld.

Send the complaint to Santander, explain that MBNA have paid out and ask them to look at the PPI that you paid to them send a copy of the printout from MBNA to show that there was PPI on there.0
