Hi - I wrote of to MBNA for my consumer agreement which they sent, i had ticked for PPI so i filled out questionaire and returned. They sent letter to say they were investigating. I have just recieved letter saying i am not entitled to refund as I ticked the box willingly... despite the fact i told them that i did so as i was advised it would be looked upon more favourably and it wasnt sold to me as optional. Really disappointed!!!!!0

Hi all ! I regularly research this forum and have taken some great advice and used it to benifits cause in claiming my ppi but having tried to sort out my mothers ppi I need some advice having rang up enquiring about ppi which she is sure she had they sent this response letter : unfortunately due to limited information available to us I can find no evidence that when you applied for your loan that ppi insurence was not included.
Decision: in light of the nature of your complaint and the fact that I can find no evidence of ppi I have concluded my investigation and will assume that you are satisfied with my findings.
However I would be happy to review your case again if you can provide any evidence supporting your claim such as a copy of your loan agreement or any supporting documentation
Any advice on this one please! Also I don't have a copy of the loan agreement !!0 -
Ok I am a newbie here but followed MSE for years , I have had a "Select " loan with barclays for years , I have filled out a claim form and they have replied saying they were unable to find any evidence that the load was mis-sold , the loan goes back for about 15 years. I may be cynical but Barclays always seem to turn me down for anything I try and claim back off them (bank charges for one). So my question is this do I hand it over to a claims company or go to the ombudsman myself ?0

Hi there a lot more reasons why you could have been misold, lots of people ticked the boxes when MBNA advised you to take the ppi did they do it over the phone or send you a letter have a look at the links below, you could consider a sar before sending it to the fos but i would continue with this, good luck.

Hi Everyone,
We have just sent off for an application form from the FSCS as we have found out that Retail Finance are now in administration.
We are putting in a claim for mis-sold ppi for the following reasons:
* An adviser came to our house and persuaded us ppi would be a 'good nest egg' if we didnt claim eg we would get the £5000 back.
* company only quoted us the loan with the ppi included
* single premium policy with the ppi borrowed at the same rate as the loan - 11% APR
* had redundancy package and 6 months full time/6 months part time sickness cover, didnt ask about it
*bought ppi over 300 months but it wasnt explained to us that we are only covered for 5 years! Will still be paying when not covered. This was not explained!
Can anyone tell us as to whether or not they think the FSCS will uphold our claim?

As the FSA only give refunds of PPI if a company have gone into administration and your loan was taken out on or after Jan 14th 05 then you will get compensated.0 -
My partner has been off work since april due to ill health we are in arrears with our mortgage but are waiting on ppi payouts which would sort out this problem is there anything we can do to hurry them up? We have just been sent a letter from one saying they have another eight weeks to resolve this!
As you have a priority debt such as the Mortgage, write to them and explain that due to your circumstances could they please prioritise your claim.
If they can't then give FOS a call and ask if they can help, you could lose your home if they do not hurry this up.0 -

If you've exhausted the 8 weeks take it to the fos, steer clear of cmc's.0 -
As part of the settlement they want me to sign a new loan agreement and use over £200 of my settlement to pay off arrears.
They use the win to clear the arrears first and any remaining money comes to you. The whole PPI amount should be taken off the loan balance and your monthly payment reduce by the PPI monthly amount, if you will struggle to make the repayments then you can tell Barclays and ask them if they will accept a reduced payment.0
