hi,
assuming you won a mis-sell case then any redress you get would go towards the unpaid loans - you would get nothing unless it was over and above the about she owes them!
also if they have not chased her for payment you could possibly be stirring up a hornets nest by poking them about PPI0 -
Hi can someone help please.
I contacted MBNA just over a week ago about claiming PPI and they told me that I had it on one of their credit cards and would process a claim for me.
On Wednesday I received a letter from them stating that they have identified they'd acquired my account from Abbey and that the sale of PPI was made by them. They also say that when they took over a new policy t&cs were issued and I was given the opportunity to cancel the new policy.
As a good will gesture they have arranged for a refund of the Rpremiums & associated interest charged by MBNA plus 8% interest. They have forwarded my complaint to Abbey for them to consider. Yesterday I received a cheque for £443.14 in full and final settlement.
Do I have to accept what they say, I don't remember receiving new t&cs. Can I ask them for a copy? Or does this mean that it's closed. What should I do about the cheque, do I return it to them if I'm not happy about the settlement? Should I contact Abbey to follow this up or wait for them to get in touch?0 -

By the sounds of it you have got back what you paid, unless they are not including the premiums that you paid to Abbey. I didn't think that these were treated separately and thought that once a bank acquired an account then they were responsible for all elements of it including time before.

Get a claim into Abbey just in case they don't consider the claim that MBNA sent to them, it is possible Abbey are looking at the PPI from when you had the card with them but make sure.0 -
hi im a bit confused about my ppi offer from black horse.
I have recieved an offer for £158.40
the calculation is as follows -
refund of premiums £952.30
less arrears on loan -£4313,97
interest at 8% £198
less tax -£39.60
total £158.40
It explains in the letter that they propose to use the refund of ppi premiums to help reduce the arrears and that if i didnt wish them to do this i need to give them a call.
Does this mean that i have an option of them paying me all the refund and that based on the above calculations i could receive much more.
At the moment i could do with the hard cash having just been made redundant.

Is this loan still running? if it is then make sure that the whole PPI amount is taken off the balance off the loan too.
Call them and ask for the refund to be paid to you as it looks like they will do this.0 -
