    No this is not an option for you, but they are giving you the chance of discussing the proposed setting off of your redress with them so that they can't be accused of treating you unfairly.
    You'll need to convince them that you have other more pressing debts or outgoings and that you have a plan in place to pay off the arrears with them. If you can present a compelling case, they may reconsider and award you (some) more of the redress.

  • Hi.. think I posted in the wrong forum before so here goes.. Hope someone can help me. I sent a request to capital one asking for a copy of my agreement in relation to my credit card. On receiving this it clearly shows that I did tick the box and sign to purchase PPI. However when I initially applied for the card, I was told I would have to pre-load my card with £200 and purchase ppi if I wanted the card as I had a poor credit rating due to my ex-husband. I was also told that if I didn’t do this I would not get the card and my credit rating would be further affected. Is it worth me putting a claim in or should I chalk it up to experience?? Thank you in advance.:)

    Thanks for the advice Cappo and Amersall, have sent letter to Halifax today rejecting their decision and asking them to reinvestigate complaint - fingers crossed!!! Another quick question - how long do they get to respond to an appeal letter???

    No timescale for responses to appeals has been set by FOS.
    Do bear in mind that you only have six months from the date of the original rejection letter to refer your complaint to the ombudsman.

    What have you got to lose? Do you have the original document with the £200 loaded? Was it done in the bank? Did you have any other way of paying? Eg employee benefits on sickness etc.

  • Hi,
    My girlfriend had numerous loans from banks and a mortgage about 7 years ago. Unfortunately she lost her house and owed money to various lenders. After her mum passed away she used her inheritance to pay off as many debts as she could. She wrote letters to them all and asked for settlement figures. The ones that replied she paid.

    I have been urging her to claim for mis sold PPI but she is frightened that if she makes a claim she will be unsuccessful and they might chase her for unpaid loans. Considering that she wrote to them and they did not reply and that it has been a long time and she has not heard from them, is she correct in thinking this?

    I am not sure if she still has any paper work available.
