Claimed PPI on Halifax CC taken out 1995. Rec'd rejection letter saying I took out card by direct mail and "as the credit agreement shows we required additional consent in the form of a signature to confirm you wanted PPI policy it can be concluded that you did knowlingly consent to the addition of the PPI policy to your credit card". Therefore complaint not upheld. My problem is that I dont think I rec'd info as to what PPI was (probably just claimed via a leaflet Halifax sent me offering a CC) and I wouldnt have needed PPI as I was in full-time local government employment with a generous sickness / redundancy package. Can I appeal and any tips?0 -
Stop it, I'll get a big head!

Hi there,
I took a credit card out in August 2003 and of course took out the PPI, as it was thought in those days that you didn't get the card without the insurance.
I cancelled the PPI a few years ago when I first heard about rip off but I never claimed at that time. However, I did put in a claim a several weeks ago and I heard back from MBNA (who were Virgin) saying that because I 'ticked the box' they are satisifed that I actively chose to purchase PPI and understood that it was optional to do so.
The letter then goes on to say that when i opted for PPI, they did not offer advice on the policy (it was done via post), that they provided information only. In other words mine was 'non advised sale' and on that basis they are satisfied that I have suffient information to make my own evulation and decision about the product on offer.
I do find this to be a get out clause that is just not viable.
How can a 'non advised sale' when you are selling a product that needs advising on be legal? And clearly it needed advising years ago because no one knew it wasn't a neccesity, I would like to know anyones thoughts and whether anyone has a similar story and what they did and the outcome.
Thanks,
Kim0 -

Yes, you can claim. It's easy.
Just get the details of the loan from the bank i.e., loan reference number, the date it was taken out, the date it finished, fill in the PPI questionairee form (download it from this site and also read the guidance notes on here) and send it all recorded delivery (not special post, which is another rip off!) and you will get a letter from them in a few weeks saying they are dealing with your claim and within 6 or 8 weeks they will let you know (by post) of their outcome.
Good luck!0 -

Write back and reject this, show you could have paid this card back should the worst happen, sick benefit, savings life insurance etc.0 -
Doesnt matter how long ago i took the loan out then or how long ago i payed it off
I have had three successful claims.
One was for £7k for a credit card that was still 'live' but that I had cancelled the PPI on a few years ago.
And the other two were for a total of £3k and were loans taken out in 2002 & 2006.
So, it realy doesn't matter how long ago it was, just so long as you have or can get hold of some information about the loan or credit card then you can claim.0
