Hi Amersall, so are you saying that u think im owed money? Basically i agreed a F&F settlement figure and payed this and the account was closed.
Then a week and half later i recieved a cheque minus the difference / i,e the bit they said they would wipe off. I thought that because the ammount was agreed weeks before the cheque was payed out, i should be entitled to the full PPI refund!? Am i wrong in thinking this ?0 -

I am trying to make a claim against reg vardy who were bought out by pendragon PLC.
I have sent copies of agreement plus the questionnaire and yesterday received a reply which has boiled my blood!!!
I quote: "we will not be investigating into this matter as according to our records, the event complained about took place more than 6 years ago and in accordance with DISP 1.8.1r the complaint is time barred....'
... Well I went to read this section And it quotes... '1,!2The Ombudsman cannot consider a complaint if the complainant refers it to the Financial Ombudsman Service:
(1)!more than six months after the date on which the respondent sent the complainant its final response or redress determination; or3
(2)!more than:
(a)!six years after the event complained of; or (if later)
(b)!three years from the date on which the complainant became aware (or ought reasonably to have become aware) that he had cause for complaint;
unless the complainant referred the complaint to the respondent or to the Ombudsman within that period and has a written acknowledgement or some other record of the complaint having been received;
So based on 2b. I am perfectly entitled to persue this claim. I get the distinct impression that pendragon have tried to use legislation to intimidate me and have picked a small part of the sub section to quote to me.
My question is this. Shall I
1) Go straight to the ombudsman, despite pendragon saying that I 'will not be able to refer this matter to the FOS as it is more than 6 years after the event and therefore out of their jurisdiction'??
2) write back to Pendragon with the full FOS section highlighted for them and see if they are prepared to back track?
Does anyone have any experience of this??

It is possible, if the full and final included the PPI, give FOS a ring and ask, also it would not hurt to get full calculations from the bank of how they worked this out.0 -

Yes you can try making the complaint to the FOS, and make them aware you did not raise this complaint up earlier because it's only recently you have become aware of the ppi mis selling, otherwise you would have obviously have made a reclaim complaint by now.

I am looking at a claim for mis sold PPI for my husband against Lloyds TSB from Oct 2006. He has the original credit agreement which clearly states that he paid PPI. This loan has now been paid off in full and in theory the bank should still have all the records as 6 years is not up yet, well not quite yet. What we don't understand, stapled to the credit agreement is a document called "Key facts about our insurance services" This document has a section saying whose products do they offer. There is a pre-ticked box indicating that they only offer a single product for the a number of insurances, which they list underneath, one of them being Loan Protector Insurance which he has on his credit agreement. In the section saying "which service will they provide him with there is another pre-ticked box saying that they will advise and make a recommendation for him after they have assessed his needs.
In the last section "stating what will you have to pay us for our services there is another pre-ticked box saying that there would be no fee but in brackets it says "you will receive a quotation which will tell you about any other fees relating to any particular insurance policy". Has anyone had a form like this or seen a form like this before? I am trying to work out whether my husband had a chance of opting out of the insurance or not. He doesn't remember very much about the original meeting and believes that he was told that he had no choice but to have the loan with PPI. A personal loan checklist was completed with a list of what has happened and what does this all mean. There is a ticked box hand written agreeing that my husband provided information to them so they could complete a Personal Summary and recommendations form. It said that he should have received a copy of these (where optional insurance is provided for the loan or other other insurance products are provided. I believes he was mis sold PPI cause it looks like that he didn't have chance to say "no" to PPI. At that time he had shortly before taking out the loan taken out a insurance policy with another Company too. Do you think we should try to see if there are more documents which we are missing or go straight into completing the questionnaire? I appreciate this is a little long but we really needed a little help from the experts, Thanks you0 -
Hello, i am new to the site, i have just got thinking about ppi due to the amount i hear about it on the radio.
I have a credit card with a limit under £1000, i have checked back as far as i am able, which is 1 year, and i have been paying ppi at a rate of just under 0.8% of my balance including a one of payment of £42.99 which was named card protection.
I rarely take out insurance on anything i buy and am sure i would not knowingly agree to pay such a high regular fee and especially not a one of fee as high as i have payed, I am unsure how long i have been paying ppi, I could not say if it was from the start of my credit card deal or added at a later date. I keep no statements or letters and if i am being honest rarely read any of them.
I would be very grateful if a member of the site or a member of the forum who has been in a similar position could advise me on how i should proceed in making a claim if that is something i may be eligible for.

If you settled this loan early then, as above you, would have a pro rata rebate and you would have paid back the remaining PPI in with the settlement figure.
Send a copy of the agreement in with the claim and use the Single Premium PPI reason for mis sell, this is the most upheld of all PPI reclaims.0 -

hi all, hoping you can help me, i have just found an agreement saying that "paysafe" will be started once my mortgage is agreed, which started in 2007, now my question is does this confirm i have the insurance cos i cant find any letters to say it was then started or cancelled0

hi all, ive recently tried claiming back ppi payments made to Connells Resedential. I got a mortgage with RBS through Connells and the ppi protection was with Wessex-Group. I have been paying the ppi on my mortgage for three years. When i brought my house i felt pressured into taking the ppi policy as she was pushy and told me i could be refused credit. As a young (21 year old) first time buyer i took out he policy as she told me to and got a mortgage. After reading an article on this website it thought the ppi sold to me was something i didnt need because the policy will pay out a maximum of 12 months which would work out to under £4000 which i have savings to cover and my partner also works and i have family who would help me out. If i got sick my work would also pay out standard sick pay which with my savings and family helping out easily cover my mortgage. I sent Connells a letter explaining this and asked them for a full refund and that i would like to immediately cancel the policy.I received a questionaire which i filled and sent back. I have now received a letter saying i was not obliged to taking the cover and i signed the policy to agree, the fact that saving does not come into account as i would not want to use them in these circumstances and that my family might not necessarily be able to support me for 12 months. I got in touch with Wessex-Group and they told me the policy had not been cancelled so i cancelled it with them. What should i do now? send another letter or just leave it? many thanks steve0
