PPI Reclaiming Discussion Part 5

    I am going through the process of reclaiming PPI from two accounts (one is an EGG credit card the other is a loan with HFC Bank) which have now been closed, one from december last year the other in 2010. On reading, Martin states you can apply for a full account breakdown even if the account is closed, I have sent the template letter to both banks and both replied saying that because the account is closed they are not obliged and prepared to give this information! What is the next step now? Do I inform the Information Commisioner (which is what i would of had to do if i had no reply after 40 days). The problem is, I don't have any of the original paperwork or any figures of insurance paid, so i'm not sure how i need to proceed. Any advice would be much apprieciated.

    I take it that was the request for just the copy of the agreement only?
    (£1 charge)?

    That's the thing when the account closes, this seems to be the case unfortunately where they state they are no obliged, but another way is if you want to request for ALL your data for the account, is a Subject Access Request (SAR) it's a full request and they have 40 calendar days to comply to this one, if they fail to comply, by the above days, you are in your right to make a complaint to the ICO. (They MUST comply to this (Data protection Act) DPA.
    This however, costs £10 cheque or postal order, if they're unable to provide you with anything, they must write to give details and return your payment.

    However, if you have the account numbers, you can still make a reclaim without the above if you want to, and they must send you a detailed breakdown once they resolved the complaint.

    You just simply complete the reclaim questionnaire below, send to the ones who set up and sold you the product, remember to keep copies as well.

    Just jumping on with a quick query! I took out a personal loan of £5000 in 2005 with monthly repayments of £158 over 3yrs. After 2yrs of repayments I ran into difficulties and arrangements were made to lower monthly repayments over a longer period of time. Of which I have to admit I've struggled with!
    On advice of this site I sent a letter in March 2012 requesting a copy of my loan agreement. They sent me a copy of the revised agreement dated 2007. I have repeatedly requested in writing a copy of the ORIGINAL agreement, to no avail.

    Eventually I sent a SAR's and have recieved in the post today,
    a breakdown of loan default issues! No loan agreement copies! No statements re this account or ANY of the others I'd requested info on! All that has been included is any issues re breakdown in some repayment dates.
    This is what they wrote in their cover letter:

    I refer to your recent Subject Access Request for information held by the bank in relation to our dealings with you.

    I enclose a copy of information relating to records held at collections Centres (previously known as Customer Lending Centres) that we have in our current and archived files

    I am not entirely sure whether I am just being blooming ignorant, as I actually expected more to arrive and certainly a copy of my original agreement.

    I wasn't employed at the time of loan and no mention was made of PPI then. I'm simply trying to figure out if I have paid PPI or not!

    Any advice would be greatly appreciated.

    Hi All,

    I'd be grateful for your advise pls - I took out a secured loan thru my mortgage adviser who in turn applied for the loan via a broker - I now found out I was mis-sold PPI. Having spoken & written to the 3 companies involved including the lender - non of them are taking responsibility for selling the PPI, apart from complaining to the FOS is there anything else I can do to get the companies to compensate me?

    Hi and welcome

    You have done the right thing now in making that complaint to the FOS.
    However, usually whoever was the one who set up your application are the one's responsible.

    Let the FOS deal with them now then and they will look into this and make sure you receive the compo your entitled to, good luck and please keep us posted.

    If the account is still active, you have the right to have the requested copy you have asked for.
    If they fail to do this, you can make them aware that by them failing to comly to your paid request, you will consider making a complaint to the Information Commissioners Office (ICO).

    If you want to contact the ICO on the telephone for the quickest method, you can do so, explain your situation and ask of the best direction to take this.

    However, if you contact the business you want to make a complaint, they should tell you if you were sold PPI or not.

    i had an account review last year at my local branch and something that was said made me think about mis sold ppi, i found MSE and all the helpful ppl and following advice on here successfully claimed MIS SOLD PPI on my credit card. I made one phone call and 12 weeks later the money was in my account ( 12 weeks was the time allowed for bank to respond at the time)
    I decided to look into old loans i had in the past and sent an e mail asking how i should proceed, Letter dated 17TH april arrived confirming they were looking into my complaint, exactly four weeks later i had a call from LLOYDS asking questions relating to my claim, and another call the next day just verifying a few things regarding my sick pay, redundancy pay etc, it is now week five since my claim started and although the bank has 8 weeks to respond i wondered if anyone who had had a refusal had it back quickly. i am hoping no news is good news!

    I have been successful with all my loan and credit card ppi via Lloyds, you should be ok, fingers crossed, keep us posted and if any probs let us know and we can take it from there.;)

    My husband claimed on his misold PPI from his bank a couple of weeks ago, he sent the original agreement and all the documentation that we had. We had took the loan out over the six year period and received a letter from them with this response.

    "Unfortunately the details related to PPI cannot be traced on our systems for the account you have quoted. This is because it is over six years since the loan was closed an to comply with our data protection obligations the records have been securely destroyed.

    In order to assist our investigation we ask that you provide as much supporting documentation as possible including where available PPI policy document and more particularly bank statements(to establish term of loan and the number of payments made) and any other relevant documentation. Please arrange to send us this information as soon as possible as we will not be able to investigate the complaint without it.

    I don't know if I think sending bank statement is not too personal and as we sent the agreement that that should have been enough information - any comments all helpful. Thank you

    I had the same scenario with Barclays and I have sent copies of a statement which shows the monthly total (loan + PPI) being paid out.

    If you didn't want them to see personal details I suppose you could block them out and only show your loan repayments.
