    ARGH!!!! I have read this a dozen times and my head is spinning now....where do I go from here? Am I fighting a losing battle???

    What year did you take this loan out?.
    They are correct as the company you did the deal with went under, makes me laugh this, it is probably the same people that had the original company who have this company that wrote you this letter.

    They have also accidentally included a copy of another customer's letter, which includes his full name, address, date of birth and bank details, so they've breached the Data Protection Act too.
    They have breached the data protection act for the customer who's details they have sent you, put a complaint in about this to Sainsburys and also the ICO 03031231113, I would not like it if it were my details were given to someone else.

    It's a poor show, I agree.
    However, I can't see any advantage in formally complaining.

    Maybe a complaint to the ICO may get Sainsbury a reprimand, there have been 2 posters this week alone that have had other peoples details regarding Loan PPI, one of them even had the claim rejected under a different name and loan number, it beggars belief it really does.
    Maybe the ICO have no real clout anyway, bit like FOS :D

    Hi,

    I've just had a letter back from Lloyds TSB re my mothers PPI complaint (I'm dealing with it for her as she's recovering from a breakdown).

    They sent on on 9th May 12 stating she would be getting back £264 from her current live PPI, and they would be closing the PPI thereafter.

    Then, just received another letter to say that they have investigated the rest of the claims (Lloyds branch gave us all the account numbers as unsure which had PPI), and they have declined 4 of the 5 (which is fine as I didn't think they had it on them anyway).

    BUT... the one which DID have PPI on it (a closed loan account), they have refused to uphold the complaint due to it not being "mis-sold". They have said that mum took out the loan over the telephone in a Lloyds branch, and that although usually a signature would be required, because it was over the phone the adviser would have given a verbal explanation at the time.

    Mum remembers telling them she didn't need it because she was caring for her sick daughter (me!) at the time, and was on a guarenteed income - yet it was still added.

    What advise can people give to go with the next step from here? This is going to be a claim of well in excess of £1000, and I'm not happy that they are refusing it on evidence they cannot provide.

    Any ideas?

    Was this PPI on the loan, paid in with the monthly loan payment?, if it was then this is Single Premium PPI, a loan on the loan that was paid to term end with interest, if the PPI was like this then use this as a reason for mis sell when you reject the " not upholding" letter.

    I'm not sure what it was to be honest... we don't have any details on the policy... mum paid it off and account was settled a few years ago (probably 2008). I'm unsure whether it was a lump sum or within interest etc. How can I find out? The letter she received was very intimidating, and I think they've done it to put the complainer off appealing! Also, the letter should state the date of the loan being taken out, but they haven't inserted it so it just says {insert date}. How is this mean't to help?!

    This is my first post so please bear with me.
    My husband has successfully made a PPI claim with HSBC for PPI on a loan he had in 2000 which was settled in 2001/2. He had the original loan document showing the PPI on there.
    We know that after this loan he took one out with the AA but cannot find any of the original loan documents. What we can see, however, is the monthly payments going from his current account to AA financial services. The loan was settled in 2003/4.
    We have asked the AA for the details by phone but they have said they have no record of any loan at the addresses he mentioned. We then tried speaking to his bank to find out if they coud provide the account details for the monthly direct debit but they have said that because it is over 6 years old, they haven't kept the records.
    Does anyone have any other suggestions so we can find out the account number or get hold of a copy of the loan document t see if it had PPi on it?

    Send a Sar request to them, enclose £10 and ask for all info they hold on your mum, give them 40 days to respond, you have 6 months to take this to FOS so do not worry, you need to find out if this was Single Premium PPI, they should have the details as this was only closed 4 years ago, if you get all the info and on the agreement it shows the loan amount and PPI and one monthly payment then you reject the rejection and use the Single Premium as a reason for mis sell.
    I know they were stopped from doing SP in 2009 so it is possible the PPI on your mums loan was SP, but best to make sure.

    Can you access your DD list from your online banking? if you can and the DD is still there, long shot I know, the account number will be at the side of it.
    You could Sar the AA and see if they have the details of this loan, some can go back more than 6 years, having said that, some don't, it depends when they destroy the Data, to do the Sar you would need the account number as they have already said that they cannot find you, you could do a Sar to your bank on the off chance the DD details can be found?.
