I have been offered a refund from Halifax for my mortgage protection plan. However they are only refunding the mortgage repayment section. Has anyone ever got them to refund the life cover and critical illness cover. They have not given their reason for the refund or in any way said that they were in the wrong.
I know I can go to the FOS but risk the possibility of losing the current refund offered. I have no knowledge of what record or basis Halifax have made their decision on.
Hi martin why would you want to reclaim on life or critical illness policies, these are very handy policies that are very useful, i claimed on two critical illness policies and they were a godsend mate as lorraine says I don't think you can reclaim on those anyway.0 -

Also at the same time im trying to claim back PPI on the card in question through Barclaycard.. they said if i was due any refund then Cabot would be payed back first as i still have a debt with them?! Would it be better for me to try and settle the Cabot debt sooner with hopefully another offer if they accept it....then, if i am due any refund it would come directly to me instead of Cabot?! What do you think is the best option for me many thanks0 -
Hi Di3004,
Thank you for your quick response earlier today and I think I may have hit the jackpot (well i hope). The loan was taken out in Sept 2001, but PPI commenced 11/10/2001 & was due to expire on 2/10/2006. PPI amount was £2776.11. I have a schedule & certificate of insurance & on bottom it states:-
'This certificate is underwritten by:CGNU Life Assurance Ltd, Head & Registered Office - 2 Rougier Street, York, YO90 1UU Company Registered No.226742.
CGU Underwriting Ltd, Head & Registered Office - St.Helens, 1 Undershaft, London, EC3P 3DQ
Company Registered No. 94405
Date - 1st January 1999'
And I believe from checking that CGNU on FSA Register these were 'No Longer authorised' on/after 6/10/2010 and that the FSA imposed a £1.26m financial penalty with them on 17/12/2007 as it breached principle 3 (by failing to take reasonable care to organise and control its affairs responsibly and effectively, with adequate risk management systems. Norwich Union Life did not take reasonable care to establish and maintain effective systems and controls for countering the risks that the firm might be used to further financial crime, specifically the risks relating to the security of confidential customer information and the consequential risk of the surrender of customer policies to third parties impersonating its customers)!!
Please could you advise me on where I need to go next as I've finally got the bullet in the teeth after all these years of trying and appreciate your help.
Thanks:A
Give FOS a ring and ask what you should now do and what would you need to do now to take this further.0 -

I do not think on the balance that you owe that they would come down by much more for the f & f to be honest, why don't you wait for the outcome of the mis sell claim and see what amount they may redress then take it from there, if they reject your mis sell claim then offer another f & f.0 -
Hello,
Is it true that since the court hearing on PPI , the banks are obliged to repay people that had successfully reclaimed prior to the court hearing? I have a feeling that I heard Martin say this on a radio show sometime ago.
Apologies if this has already been answered elsewhere ( This is my first post )0 -

I've never trusted those Banks who take the reasons for mis-selling over the 'phone. It means there is no paper trail of your complaint.
Ring again and ask for the reference number of your complaint and write this on the top of your questionnaire.

If you had a claim in before the JR then Barclays were paying these out "no quibble",if the claim was put in after this then the banks look at it to see if the PPI was mis sold.0 -
I think I have a claim against EGG banking but I am really confused about who to write to. Is it the Derby address? Any advice would be appreciated0
