    I assume this was closed long before the one you have won with?.

    Don't think a Sar will help with this due to the time, you could try and see what you get back, they should give you all info they hold on you, it could be that this loan may show up?, nothing ventured nothing gained!.

    Hello Everyone.
    I'm a total newbie to this, I just wanted to see if anyone could give me the advice I require.

The bills would always go to my mothers address so the card itself was taken out prior to 2002 which is when I moved to my current address, so I have been paying PPI since I got the card. Do I have grounds to claim back this money, I never claimed on it and have been employed since before getting the card. I read somewhere on the site that I would need a credit history report and another post stated that a customer rang MBNA directly. I'm just so confused, some people have stated on here that they knew how much they were claiming back, I myself would have no idea how to work that out. So basically I would like to know were I stand in regards to making a claim and what should my next steps be in regard to getting this money back....if possible!

  • I had a MBNA Platinum Plus Credit Card that i made a final settlement offer on in 2010. So the account is now closed. I believe PPI is seperate to paying off my account in this way, but feel free to tell me I am wrong.

    I believe that I filled in one of these leaflets that used to be rammed in magazines in 2001 to apply for the card, but in their response MBNA say the application was made online and that I therefor could make my own informed decision about the PPI.
    My basis for the claim was that I was misinformed, as i definately spoke to someone at MBNA to ask about the PPI, that I was in temporary employment (though I now realise my dates were wrong!) and that i believe I had pre existing medical conditions that would have rendered to policy void if I had ever tried to make a claim. These were SVT, hyperthyroidism that then changed to hypothyroidism and subsequently atrial fibrillation. Hypothyroidism alone requires medication for life and can cause further problems down the line, which it has(I am signed off work at the moment through thyroid issues).

    After my initial letter, they asked me for evidence of my medical conditions which I obtained from my doctor at a cost of £25! They said if did not reply, that they would make a decision based on information they had already gathered.

    The response came through this morning with a copy of what appears to be data/information extracted from somewhere, but it gives an IP address that I dont know if it is mine or not as i have changed provider since then. Like I say, I am pretty sure the application was initiated with a magazine fall out.

    Another thing they have sent me a copy of is what would appear to be the tear off reply slip of the letter they sent saying my application had been accepted. I think what they sent is the bottom half of the letter I still hold, it has the option on the tear off to accept or decline the PPI. In the sentence beside the Yes or No boxes, it states that 'WE STRONGLY RECOMMEND THAT YOU TAKE OUT THIS COVER' - I cannot determine from the photocopy if this box is prefilled because of what I may have put in the leaflet or online (as they suggest) or if I have ticked this box before signing and sending back this tear off slip. (what I do know, is that either way, I did speak to a representative of MBNA at one of these points prior to ticking the box, and distinctly remember the question coming back - 'How would you pay the balance if you were made redundant or worse still, if you were to die'. I remember stating my pension would cover me on death, but yeah, I had no means of funding unemployment.
    Has anyone been in a similar situation, and if so, did you progress your complaint to the FOS?
    Any other comments are welcome.

    On a ligher note, I did all the paperwork for my barber and managed to get him £12,000 back from MBNA as he was self employed.:beer:

    Thank you for your reply amersall. The loan ran full term for 12 months - it just seems that it was in 2000 the interest should be higher as it was taken wrongfully from me 12 years ago?

    They have paid you the interest and the ppi you paid for the 12 months, this is the ppi total that you stated, that is correct.

    The interest is the 8%, this is on a decreasing scale up to the date of redress.
    Your ppi payment was £10.02, put this amount into the calculator for the bank charges, put month date and year of each payment and it will total this for you.

    Watch how 8% per month goes down each month that you paid this.

    Put all the reasons you state above and a copy of the Doctors certificate.

    If this was not the final response, then do the above back to MBNA and ask them to reconsider the decision or you will take this to FOS.

    You are correct as the ppi is on each monthly statement so when you paid the card off you would no longer pay this.

    Thank you for the response 'AMERSALL'...it has lifted some of the disheartedness!!

    Additionally, I had tried in about Jan 08 to cancel the PPI but with the pushy person on the phone, I still came away with some element of cover. I mentioned this in my complaint and they made no reference whatsoever.

    I will gather all the evidence and get on to the FOS, as that was their final response.

    I just find it funny but not funny that they ask for doctors letter then made no reference to that either!!

    Hiya. Am new to posting but seems theres lots of great advise so decided to ask for help. I am in a DMP with the CCCS and it includes 4 credit cards. Wasnt sure about any PPI except for 1 card (Capital One) so filled out MSE templates asking for credit agrement and paying £1. Have had two back but they dont give me any clue to whether had PPI or not.

    OPUS ( for BMI/Citi card) - Tells me its a copy of the original credit card agreement BUT it hasnt included a signature box because it doesnt have to! (accordance to regulation3(2)(b) (ii )
    of Consumer Credit regulations 1983.In the credit card agreement (30.04.07) it mentions cardholder repayment protection & card protection plan plus but no indication I signd for it.

    Bank of Scotland (AA card)

    Has sent copy of signature but says nothing at all about any Card Protection.

    What should be my next step? Many thanks

    How long ago were the cards and are they still active?
    Old statements are your first line of enquiry, with credit cards if you were paying PPI it will be a separate figure each month.
    The banks only have to keep records for 6 years, if the cards fall within that period you could contact each bank and simply ask if you were paying PPI or even go into the local branch and ask. You will need account numbers and proof of id .
    Copies of statements from the banks can cost £5 each so not cheap
    The other option is to SAR each bank which costs a one off fee of £10 each bank (again not cheap when dealing with different banks) but they will then have 40 days to supply you with all they hold on you.
    Whatever you do DON'T use a claims company to do this. You MUST do this yourself as any redress you may get will go towards clearing debt and if you use a claims company they will bill you and you could end up out of pocket.
    Try and dig out any old statements or contact them and ask the question directly, you just need to know if you were paying PPI initially then you can look at reasons for mis sale and see if they apply to you ;)

  • I rung up MBNA three weeks ago now and over the phone they said that my credit card complaint had been 'upheld' and that it was now in the process of cancelling the PPI and going on to the 'money' dept where i assume they issue a cheque. He said the process would take around 2 weeks but that had already been sent off prior to my phone call.
    I'm getting a bit worried now as it seems a long time to wait or am i just getting anxious for no reason?
    How long do you normally have to wait and would it be worth another phone call?
