    Hi

I sent letter to company I used to have credit card with, they have said as the account is now closed they are under no obligation to comply with a request for a copy of the executed agreement under the Consumer Credit Act as we no longer have a contractual relationship relating to this account. The right to be provided with this information from the lender ended with the closure of this account.

    Is this correct?

    thanks

Can't answer that for you Paul

But if you hang five,i am sure someone on here will :)

I am new to all this myself :o:D

    (Moved from the sucess/failure thread)

Received a reply from MBNA stating they are turning down by complaint as I had ticked a box for PPI, thus it was a non-advised sale. They enclosed a photocopy of the agreement which shows that I have ticked the box.

I had raised a complaint as I could have sworn that this policy was sold to me over the phone...

They have also stated that this is their final decision and to go to the FOS should I wish to take it further.

What are my options now? As far as I can see, I have none : I ticked the box

Amersall / Dilus : Any advice please?

    Many thanks

Don't worry fifitrixiejane, give them time to do their thing. You have the uphold, it's at the payment stage, give it another week or so they are normally quite good at paying ;)

Thanks for that, maybe i will relax a little. Since hearing that it was upheld i've been on tenderhooks for the arrival of the letter, mainly to see how much i got and of course i'm using the money to pay the debt off.. just have to wait and see i s'pose! ;)

Is your sis being compensated for 90% of the total ppi amount, or is that what is owed when she gets the compensation from FSCS?.

I had a long conversation with GE Money on Friday and they told me that whilst the loan agreement clearly states the amount to be repaid is £13,259, that doesn't include the £1537.50 (+interest) in PPI. So in total (the guy said) the loan will have cost in excess of £15,000 upon full repayment. He also said that without the PPI the loan would have cost £220.98 a month, but since Norton have gone bust, GE do not have to take any notice of the Ombudsman's ruling, so the payments to date will not be recalculated, and even though the numpty at the FOS asked why the loan repayments hadn't been reduced following the cancellation of the PPI in April 2011, GE are maintaining that £1800 of capital still remains on the loan, £30 is interest per month, so in order to clear the loan we would have to pay £330 a month until September (nearly £70 more than when paying the PPI premium), and if we're lucky will get £1,453 from the FSCS. To top it all, with this country's delightful government and its blatant prejudice against the disabled, there's a good chance that her Disability Living Allowance will be reduced in April IF it's renewed (which, even though her condition has deteriorated, is unlikely) she will be forced into greater povery than she's in now, all whilst lining the pockets of the disgustingly greedy merchant bankers in government and finance.

Hi,Anyone help on this please,my hubby sent his claim to Barclaycard about six months ago,he had to wait the full amount of time 16 weeks plus to be told Sorry but beens you were self. Employed and then became a ltd company, you cannot claim, and yet exactly the same circumstances with HSBC,and Lloyds and they have paid out,we have sent it on to the Ombudsman two plus months ago, heard nothing yet.
Question we would like to ask,as anyone applied to Barclaycard with the same circumstances and got a different reply to what we have heard, ask for a list of there rules from 1999,but they said were not available.Seems strange them saying they would pay out and yet other banks paid up.
    Anyone help on this please.
Thanks, hope some have had good news.

Hi can any help me please?

I put a PPI claim in with Nationwide on a mortgage we took out 2003. They have now replied saying they are not upholding the complaint. The reasons :-

The mortgage application was submitted by a third party intermediary.
The policy was suitable for your circumstance at the time of the sale.
There was nothing to suggest that you had sufficient existing cover in the event of accident, sickness or unemployment.

And it goes on. We were told that we had to have the insurance to secure the mortgage and no further information was given regarding the PPI. We had substantial savings at the time of the application which could have secured our mortgage payments for over a year if we were made redundant.

Is there any more I can do now, or accept their decision? Thanks

Hi - posted this last week but no response - can anyone advise? Many Thanks

Hi, just wanting some advise please. I took out a loan in 2005 and settled in 2006 with citifinancial, we had been mis-sold ppi, they told us we couldn't have the loan without the ppi. Anyhow i have decided to make a claim. I dont have my t&cs or loan agreement so i went on to equifax for details. I have also phoned citi and they gave me my full account number and address so i can claim in writing, he also told me i did take out ppi ( which i already knew). Do i still have to send a letter for my loan agreement or can i just send a letter stating i want to start a claim. I'm very confused on what to do next, please help. thanks!
