We also have this problem with GE Money and the firm who sold it has gone bust. Can anyone advise where to go next please?

You need to put the mis sell into the insurer, if they come back with a no then FOS will chase them, same for the poster who originally asked the question.

Am having real trouble claiming money ack from both Barclays and Halifax.

The loan with Barclays was from 2001 and I just got a straight no as it was before they had signed up to some agreement.

Halifax agreed to pay me £4300. They sent me a cheque for £1600 and that's been it. It's been 2 months now since I had the £1600 and every time I ring up I keep getting fobbed off with excuses that it's being escalated and they are very sorry it's taking this long.

I'm fed up now as I don't know what else I can do. I have it in writing they have agreed £4300 they tell me that's what I'm owed on the phone but still no money b

I don't know what else I can do.
Write back to Barclays and tell them the FOS said they can look at this mis sell, ask them to reconsider or you will go to FOS, do not know what to tell you re the Halifax, just keep pestering.

    Hi

I sent letter to company I used to have credit card with, they have said as the account is now closed they are under no obligation to comply with a request for a copy of the executed agreement under the Consumer Credit Act as we no longer have a contractual relationship relating to this account. The right to be provided with this information from the lender ended with the closure of this account.

    Is this correct?

    thanks

You need to send a Sar, the agreement may not show ppi anyway.

If you have the account number and reasons for mis sell these are all you need to put a claim in.

Thank you for the reply :)

How are things with you i hope you are keeping well and being good:p :D

I have never done a Sar before,i have heard of them on this tread and thats about it :o:D

I understand a Sar only goes back a certain number of years on a account and i agree with you nothing ventured nothing gained so i might just send a letter off, thank you for the link,if i do have somthing back from a Sar what sort of proof would it be,would it be like a copy of the original loan policy sorry to sound i bit thick but my brain is not working today well i don't think it works anyday to tell you the truth :o :rotfl::rotfl::rotfl:

    XX

:D You are welcome, how's tricks? nice to have you back.
If they find you from the SAR, the agreement should be there.
    Good luck x.

    Many thanks

Take it to FOS, give all the reasons you may have been mis sold and let them know that you think you did this over the phone and if you did there should be a recording to prove this and you want to hear this.
Sorry no one answered this :o:o i have not been on a lot this past week and when i did get on there were so many posts i did not have the time to answer all of them :) i felt like the lone ranger at one point :rotfl: i was going to post the question "where are you tonto" :D:D:D

I had a long conversation with GE Money on Friday and they told me that whilst the loan agreement clearly states the amount to be repaid is £13,259, that doesn't include the £1537.50 (+interest) in PPI. So in total (the guy said) the loan will have cost in excess of £15,000 upon full repayment. He also said that without the PPI the loan would have cost £220.98 a month, but since Norton have gone bust, GE do not have to take any notice of the Ombudsman's ruling, so the payments to date will not be recalculated, and even though the numpty at the FOS asked why the loan repayments hadn't been reduced following the cancellation of the PPI in April 2011, GE are maintaining that £1800 of capital still remains on the loan, £30 is interest per month, so in order to clear the loan we would have to pay £330 a month until September (nearly £70 more than when paying the PPI premium), and if we're lucky will get £1,453 from the FSCS. To top it all, with this country's delightful government and its blatant prejudice against the disabled, there's a good chance that her Disability Living Allowance will be reduced in April IF it's renewed (which, even though her condition has deteriorated, is unlikely) she will be forced into greater povery than she's in now, all whilst lining the pockets of the disgustingly greedy merchant bankers in government and finance.

:mad: i know how you feel about this country, i feel the same.
My Daughter and Son in law emigrated to Australia today they are sick of what is happening to this country, it has gone to the dogs big time
Sorry it did not work out with the ppi, i know it is no consolation but at least she will get the £1,453 it is better than nothing, but she should have had full redress
