I think, no claim no, no problem, you wont be able to respond without claim no

Never ignore, without checking, any court paperwork. On the rare chance its real then they would get a default judgement which gets a lot more complicated.
I'd rather be an Optimist and be proved wrong than a Pessimist and be proved right.

hi, my court paper as got the same SEAL circle on it,is stamped as the rest of the page but in the box at the top only say Northampton county court,no claim number,no phone number ecc ecc...
On the cover letter they state the intention of taking me to court and this will be the form they fill up and submit to the court i guess.
but how they can prove i recieved the penality notice?
what if no letters never reach me?
if i m not aware of any liability due to the civil enforcement ltd can they still ask me for loads more money than the original fine?
At the bottom of the claim form ther is a note saying :
N1 claim form (CPR part 7) (january 2002) crown copyright.reproduced by sweet and maxwell ltd
can ANYONE tell me if is genuine?? pls
    thank u thank u thank u

That is clearly harassment ! a court would take a very dim view that papers were being used the threaten the alledged defendant.

I would respond to that letter by means of a letter before action, you would win hands down in court if you were to sue them for harassment and produce that as evidence.
You may click thanks if you found my advice useful

I would fill it in and send it back to Northampton court, seal, case number or not, let them see that some crook is issuing fake court documents.

  • thank u,
to your experience is this the last step b4 they really submit a claim to the court or they will back off if i dont reply as usual......
    the charges are:
damages arising from a breach of contract
and they also attached the copy of the letters they send me previusly, this seems ready to go,all fill in,will they go that far if they didnt have the intention of taking me to court for real?
Can they take me to court on the basis that i m the owner of the car without know if i was the driver at the time of the contravention? never i was asked to provide information about the driver or never were the letters refer to the driver..... i m responsible for my car under all circumstances even if i dont know who was the driver on that day? (prob me but i cannot remember after 6 months and i do not keep records of who drive my car).
sorry i m confuse and if does go to court i dont have any knoledge in law i ll prob !!!! myself in front of a judge :(
  • Chaps, in view of the fact there's a genuine claim to be defended here, I would ask that all further comment or speculation cease on this thread in regard to Timbo? The matter is in hand and all I will say is that I am optimistic about a result; but we don't want the "spies" eavesdropping.

Fedupowner, they will NOT take you to Court for being the owner or keeper because they can't, they proceed upon the assumption that the keeper was driving, but ONLY the driver would ever be liable and it is for them to prove.

Without that evidence their case would never get past first base, which is why they are frightening you instead of suing you. If you get a REAL form come back and tell us and we will make them eat it.:rotfl:

If there is no claim number, no unique password to access the claim on the Money Claims Website than the chances are it's fake.
