So, less than a fortnight after the first Roxburghe letter another has arrived. Here are some selected quotes....You were recently sent a Notice to Registered Keeper and to date we have not recieved
-Payment
-An appeal
-A dispute
-Confirmation if you were the driver; or
-The name and address of who the driver was if this was not you.
Please note that in the absence of any of the above, we will continue to pursue this matter.
If we do not hear from you within 10 days, we will pass the matter to our solicitors, Graham White, who will review your case for potential legal action
We are fully aware of anecdotal information being presented via the internet and on various websites and you may well feel this guidance is worth following. We strongly urge you to seek independent advice rather than rely on these opinions, and we would respectfully suggest that you refer to s52 of the County Courts Act
Roxburghe clearly think I'm dumb enough to not realise they also browse these websites gleaning information where they think they might be able to pressure someone into paying them some money that are not entitled to.
None of these muppets will be getting a brass button out of me, and whatsmore I'll be considering any further letters or contact of any form to be harrasment and will be persuing that with my own solicitors.0 -
About involving your own solicitor, I really wouldn't bother. You're clued up enough to represent yourself and any lawyer would only end up taking money off you and for what? To get the muppets at the other end to stop their campaign.
If the experience is not tormenting you then you would have a hard job to prove you are being harassed. Unequivocal knowledge that their demand is unenforceable and unlawful is sufficient.
Each time they send a letter, it costs them. If you wish to have fun with Roxburghe as I have had, you'll see their address on your mail - just mark the envelope "REFUSED AS SCAM - RETURN TO SENDER" and cross out your own address so the muppets at Royal Mail don't resend it to you. This way, they'll have paid for you to receive the letter and for your reply which they will read!0 -
It is pleasing to see that someone at Roxburghe has done a little legal research (its OK Steve we won't name you again - well not here, any way) and continues to do so as we flatten each of the arguments they advance. It's just a shame that they always manage to come up short.
Although s.52 confers powers on the court to make orders for the identification, preservation and production of real and documentary evidence it does not, of course, include a power for the court to oblige someone to name a driver - which is the reason it was quoted in the first place. And no such power exists in civil law.
For as much as Roxborg, and others of the same ilk, would have us believe that debt collectors must be obeyed the truth of the matter is that they have no powers to oblige payment or disclose personal details beyond those of the man on the "Clapham Omnibus". In essence, all they can do is to ask a putative debtor to pay up. The reason for their scrabbling around to quote some vaguely relevant statutory provision is simply a function of the fact that they know they have no power but will go to the ends of the earth to hide that from the people they deal with.

As expected another amusing letter arrived this morning that I will no doubt use to wipe my a**e at some point.
Also as expected its from Graham White Solicitors, signed off by some clown called Michael Sobell.
Aparently....blah...blah....recover the sum owed....blah...blah.....<insert more pseudo legal bulls**t here>...blah...blah......you owe us £207.
This is becoming comical. Its almost like free entertainment, as I read out the letter the whole family sitting around laughing at these morons.
Also on the plus side I'm making a saving on toilet roll as I'm getting it delivered for free!0 -
I'll add to your growing joke but letting you know that Mr Sobell is a real person, who once upon a time was a solicitor who came up with an even more ingenious money making scheme than a PPC. He 'sold' his name to the GW outfit so that they can use the 'solicitor' term in their letter heads.
We understand that he is currently under a monitor scheme run by the law society due to GW's antics. He's also getting on a bit and is unlikely to set foot in any court room any time soon.0 -

Reading all of this seems very encouraging, especially as my husband returned last night with a LDK parking charge in his hand. His story is he took our son to watch Middlesbrough last night and the car park he normally parks in was full, but next to it was a company car park which others were parking in, which did have signs up advising private car park. He asked a couple of people if it was ok to park there (being it was 7.30 at night and it was obviously not being used by the company it belonged to), and was was advised they were parking there and it should be fine. As you can probably guess, upon returning after the match (boro won 3-1:)), he along with about another 20 cars, all had parking tickets issued by LDK. This may be a silly question, but is this an example of a ticket that can be ignored (being that we are not claiming to of had a ticket displayed etc)?

3. Watch this Watchdog clip; the only thing that's changed since this youtube clip is that they no longer need to know who was driving and - if they have reasonable cause - they 'can' send the letters to the owner/keeper - who 'can' still ignore them!:
