Can anyone advise my next course of action. Received a parking ticket 07/11/2012. Was parked in a disabled bay. Not on purpose mind you, I'm not trying to be clever here. On the private site where I work, I know there is massive complaints about the parking police. They are like hawks and slap tickets everywhere within sconds of time restrictions and slightly outside lines. I am aware of their reputation, and know I have to be careful. However, isn't this a ridiculous way to feel about the simple task of parking your car and going to work? I normally park in a safe area each morning but I wasn't due on site this day until the afternoon. I had to look around a different part of the site for a space, and spent most of my time focusing on any gaps between cars as the site looked busy, so if I saw a spot, I knew I had to be quick to get it. On the end of the aisle through the middle section was a space, though difficult to see due to a 4x4 Volvo petruding next to it. I quickly spun my car into the space. I checked the area to see if it was okay to park there. There was no chevrons, writing or lines around the space, or sign next to it stating I could not park here so was confident to go to work. I was ticketed on my return for being in a disabled bay, however, the only way of knowing this was by the wheelchair symbol, now underneath the car and obstructed. I appealed, and did not hear anything for over 2 months until I received a formal demand. I rang the company, to which I was put on hold while they looked to see about my appeal. The girl on the phone apologised, and did not know why the appeal was not looked into, although, they state they will give written answers within 28 days on their website. I was told an answer would now be fast tracked within 7 days, and have just had an answer that the appeal is rejected, and must pay. Looking through this website, it appears that I may have a few points here. The poor signage. The proof of breach of contract, and if so, where does this firm come into this, as they could not adhere to there own timescales. I still want to dispute this unfair charge, and not sure what to do as my next step, can anyone help, please???

None of the issues you raise matter because a private company cannot fine you or impose a penalty for parking in a disabled bay. Which company is it by the way?

LDK have never done court to my knowledge (I'm sure Alexis will confirm this). They have previously used debt collectors called EDRS Ltd (Ethical Debt Recovery Services Ltd). What they don't disclose is that EDRS Ltd operate from the self-same offices as they do at the MK2 Business Centre in Milton Keynes - despite the fact that EDRS purport to operate out of a well-known accommodation address in North London. As if to confirm the link the two directors of LDK just happen to be the two shareholders of EDRS.

EDRS - like any other debt collector - has the accumulative legal power of a dead sheep in pursuing a debt - in fact slightly more because they can actually ask you to pay them. They are easily ignored and, as Trebor has said, you could only be pursued by LDK for their losses. In a free disabled space? I think that amounts to a fat zero.

Do not waste your energy in writing to them - and keep in mind that there is no appeals process worthy of the name in the whole of the private parking company world. There is good reason to believe that so-called "appeals departments" are simply the next desk along. Writing to them will only serve to let them know that they have a hooked fish so ignore them and their increasingly threatening letters from now on. The letters will threaten all manner of things, courts, debt collectors and bailiffs and then.....it will all go quiet.

    Stay strong and ignore them.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com

A wheelchair symbol does not make a disabled bay.

In fact, the Blue Badge Scheme does not apply on private property, so any claim based on that is quite surplus.

So, stop communicating with them and ignore the letters from them and their fake "debt collectors"/solicitors that will follow. You would help all of us by depersonalising them and adding to the letter chain sticky at the top of this forum. :)
  • Concur with the above. You have made the mistake a lot of people make and taken what they say seriously. They have no power whatever to fine you; and if you refuse to pay there is nothing they can do about it. There is no provision at all for "disabled parking" on private property.

From now on don't waste any more time on them. Just ignore any correspondence you get from them, either directly, or pretending to be a debt collection agency.

Throw it all in the bin, and I guarantee that in a few weeks' time they will have given up and crawled back into their hole.

    When that happens:

    1. Come back on here and confirm it so other victims will be reassured that our advice works

    2. Tell all your friends NEVER to pay a "fine" from a private company, and tell them to tell all THEIR friends... and so on until everyone is wise to this SCAM.

As others have said, it really is easy to ignore this scam.

    1. Read the sticky thread, 'PPC letters & threats'. If unsure how to see the forum index (stickies at the top) see my signature.

    2. Check out which standard letter templates will come next.

    3. Watch the Watchdog clip on the same sticky thread.

    4. Ignore the scammers and tell your colleagues/friends/family about this con.

    5. Why not COMPLAIN to your union and your Line Manager about this harassment - show them copies of the worst threatograms so they can see what gets sent out to their customers & employees (but do not 'appeal', do not pay and do not be told to do either by any berk who thinks the fake fines are real!).

I don't know what de-personalise means in this context?

And you can't add to the top sticky thread, it is closed as it isn't there for comments. Crabman clearly says pics of new letters should be sent to him by private message - but only if the letter is not already shown. Then he will add it.

Did you look at all the letter-chains (not just looking for one single company, LDK?). These companies all use the same basic few debt collectors so you will soon know which letter-chain is being thrown at you and chances are your letters are already posted there in the top sticky.

De-personalise means to blank out your name and address, and the ticket reference number, before scanning the letter. This can be done by covering them with a bit of card.

There are instructions as to how to upload the scans in the stickies at the top of the forum.

If you can't do it, don't worry too much, as Coupon says they all use much the same rubbish, it's just nice to have the full collection!
  • I received a parking ticket at the end of 2011. I was parked on a private sight, i purchased a ticket and I believe it was facing the correct way. I appealed and sent evidence of the purchase of my ticket. To which they refused and said they could not see my ticket.
I ignored them after reading advice on line - but I ahve recently received a letter from the debt agency saying they will contact their solictor in 10 days if I have not made the payment.
I plan to ignore but I am getting a little concerned that they are goign toc lamp me at home or if I dont pay take me to court and my credit sscore will go down.
HAs anyone else got the stage of the debt agency being involved?
