    You are safe on even more levels than most!

    1. They cannot charge anything more than actual financial losses incurred. This is zero. It isn't £60. Even if it was it couldn't then magically become £90 and then even more magically £120 depending on which day you paid it. So they're scuppered on that one.

    2. Disabled Bays on private land are legally meaningless (same status as graffiti).

    3. At best, they are for drivers who are disabled, not necessarily drivers who display a blue badge, so failure to display is not a contravention of the terms of the bay

    4. Your Dad was displaying anyway.

    You COULD write back and state that your father IS disabled and was displaying a badge (which he was not obliged to do so), and they should go and whistle. At which point, any further demands from them not only constitute harassment, but are an offence under the Disability Act.

    Or you could ignore. Your choice.

    In a word, yes.

    As you paid the car park owner their charge, you don't legally owe anything more. Therefore, debt recovery, courts, CCJs, bailiffs are all empty threats.

    The Blue Badge scheme doesn't apply to private car parks. However, if he's got a BB, he is probably disabled under the terms of the Equality Act 2010.

    If so, he would have every right to sue both the car park owner and their agent, the PPC. The car park owner needs to be made to see what the PPC is doing to their customers.
    The acquisition of wealth is no longer the driving force in my life. :)

    My Disabled (blue badge) father parked in a private carpark near the Hartlepool Mail office last week and recieved a ticked from LDK.

    They have demanded £90 reduced to £60 (if payed promptly) and increased to £140 after 14 days.

    There are further mentions of debt recovery and baliffs involvement.

    The reason given on the ticket for its issue is: Parking In Disabled bay.

    My father was only parked for 10 minutes and was displaying his blue badge in the window.

    Am i safe to just ignore this ticket?

    Of course you are safe, this isn't a real fine, it's a scam!

    You could sue them for harassment though, or your Dad could sue them under the Equality Act 2010 as he was perfectly entitled to use the space as he is disabled. He wouldn't even need a Blue Badge as it doesn't apply on private land.

    Do not appeal nor pay but if you want to think about suing them for compensation over this harassment and disability law breach then please reply again to us here as you would need to set the ball rolling with a carefully-worded letter up front now.

    Yes. This sounds very much like a case for suing the arrogant, incompetent pr*cks. If you are interested come back and explanations will be offered.

    But whatever happens, do not give them so much as a bent foreign coin.

    Thanks so much for fast and concise replys.

    Whilst discussing this with my Dad he has also told me that the person issuing the ticket was at the car when he returned. The ticket was not put on the car but put into his hand. Im not sure if this forther contravenes any other "rules".

    There is some confusion though as to whether my Dad failed to pay for a ticket or not. The ticket issuer told him he should have payed but from where the car was parked my Dad says there was no ticket machine visible. Although i understand that in any case all that could be claimed back via breack of parking contract is the cost of the ticket.

    My parents are both in their 70's. My Dad 77. They are unlikely to want to go to the bother of "Suing" and really just want the worry of the parking "fine" to go away. I've read out all the posts on this forum to them and think I have pretty much convinced them that we can ignore this issue. But still they worry.

    I will deal with any corespondence recieved from LDK and if I consider it threatening enough or to have caused distress to my parents I may well persue the option of suing LDK myself.

    Fair enough, up to you, just so long as it's clear that no money should be paid to these robbers.

    If you want to get rid of them, try this. Send a couple of sheets of paper to them writing a note telling them in no uncertain terms that you won't be paying them anything. You can enclose their ticket (or a photocopy) with something rude scrawled across it. You then send it to them in an envelope with "Payment enclosed" written across the top- but DO NOT PUT A STAMP ON. They will have to pay out to get the letter, and also realise that you are so unafraid of them that you are taking the p*ss out of them. They don't generally bother to carry on after that, but if they do, and you do it after each letter you get from them, they quickly give up.
  • Oh rest assured, these scumbags wont be getting a penny.

    I'll certainly return here for further advice should I deem future corespondance from LDK to be harrasing or threatening in relation to previous.mention of the Eqality Act.

    In the meantime, your suggestion re:writing them a letter has tickled me. I think ill be trying that! Im very much if the school if thought of "get in their face and tell em where to shove it".

  • For some reason, i am unable to log in under my original name, so added a 1 on the end. we received the letter from LDK, and Roxburghe debt collectors, but after reading the mse members letter, and because we had a valid ticket, we are ignoring everything they send us, and will remain defiant all the way. i dont intend fattening their pockets one bit, no chance. and a big thank you to all the members on all the cowboy parking threads, who have given me the will to do so. THANK YOU

    This morning received a letter from Roxburghe Debt collectors. They are requesting £150.

    This will of course be completely ignored.
