and someone advised reading the ppc letters and threats link. i must be stupid cos i cant find it - can someone post a link - thanks
    Yes.

It is actually at the top of the listing for this forum cunningly hidden under the title: Sticky: Private Parking Companies' Letters & Threats :)

LDK's letters have yet to be listed but if you have a look at the selection of other companies you will see that the wording is just a variation on a theme.

Make sure you watch the BBC Watchdog video (Blue linky at the top of the page). Although this involves MET Parking the advice for LDK is exactly the same.
My very sincere apologies for those hoping to request off-board assistance but I am now so inundated with requests that in order to do justice to those "already in the system" I am no longer accepting PM's and am unlikely to do so for the foreseeable future (August 2016). :(

For those seeking more detailed advice and guidance regarding small claims cases arising from private parking issues I recommend that you visit the Private Parking forum on PePiPoo.com
  • Lets put it this way people, I have been parking in my car park at work, for a year, and LDK took over in October, I have received 67 tickets, which, after all their increases, add up to £19,080.00 :D they have called my mother, my sister, sent a lot of threatning letters, which are badly spelt with terrible grammer. If they could get the money, they would have taken me to court by now. I know they won't because it doesn't cost anything to park in my car park! I am clearly p***ing them off as are my colleagues, as they are sticking the tickets in the same plce and dangerous build up of plastic is accurring, which I have in no uncertain terms said.... please take me to court, and I will, please!!! and while we are there i will sue you for criminal damage! needless to say they keep sending the letters, but I haven't been served with papers..... I'm just happy to watch the letters come in. It makes me laugh! Don't pay, there is no legislation back up their fine. Check on the parking association website to see if they are registered, they may threaten to "demobilise" your car, but not many companies actually have a licence to clamp, so ignore that!! Doesn't matter what they tell you, they are unenforcable, I hve spoken to my solicitor and he says they are a bunch of pirates! I beg you not to pay they are worse than scum!! and th way they have threatened my poor mother is abominable!!

You obviously have the bottle Bexxy. So if they are harassing your mother- sue them! Unlike them, you DO have a case!

Ha ha now it's got to that amount it won't fit in small claims any more and the last thing they will want to do is to try and pull the wool over the eyes of a proper Judge...

From FA's example, that could've been 67 harrassment cases at £1000 each. I wouldn't recommend sueing your employer though: why kill the goose that lays golden eggs?

PS. Do you have any vacancies? :)

  • I read through this and a couple of other threads about LDK and after checking on the british parking association website (sorry not allowed to post link) as advised above and seeing that LDK were registered to issue tickets, I also read a telegraph article online published in march of this year about them getting details from the DVLA (again I can't post the link) - And so I am wussing out and paying, even though I am very angry about it.

My story in summary, I use their car park daily for work at a cost of £2. This morning my money got wedged in the machine and couldn't be rejected, nor would it issue me a ticket. I called the 0845 number but it wasn't manned at 7.45am, as I didn't have any other cash, I wrote a note on my dashboard including my phone number and went to work. When I was free later in the morning I called the 0845 number again and they said any note would be ignored as there were 3 other machines I HAD to pay, so I borrowed 2 quid and went back, approx 10.30am. Of course there was already a ticket with a 'fine' cost of £60 if paid immediatley, or 90, or 140 depending on date of payment.

I wont be parking there again due to such an unsympathetic approach, but I really can't face the flood of threats and phonecalls, as I do understand that I was techincally in breach of very clear signs and on camera.

    NOOOOOOO!!

The British Parking Association is a trade body, not a regulator. Their members are pretty much all in on this scam. The scam works like this (in a nutshell):

    1. Issue a ticket to a car parked on private property
    2. Private organisations and individuals do not posess the statutory authority to 'fine' anyone, so ticket must be issued under civil contract law for 'breaching the terms and conditions of a contract' (the signs).
    3. Under civil contract law, the only redress for breach is ACTUAL LOSSES INCURRED.
    4. In free car parks this is zero, in P&D car parks this is the cost of a P&D ticket for the time your car was parked there. IT IS NOT £60 (or whatever).
    5. Action can only be brought against the person who entered into the contract which can ONLY be the driver. Note that they usually don't know who the driver is, so cannot be sure they are chasing the right person.

For these reasons all these private parking tickets are legally unenforceable. You owe them £2 only. Of course they also owe YOU £2 for the coins that got jammed.

Legally, under civil contract law you most definitely DO NOT owe them £60.

Please do not pay, you are just being mugged and funding scammers so that they can perpetuate their activities of trying to mug yet more unsuspecting drivers.

We can't, obviously, stop you from paying. All you will get from this bunch of scammers is a series of letters after which they will disappear out of your life for ever.

If you would rather pay £60 (be careful they don't try and scam you for more by saying it's late, that what they often do when they find a "mark") than put a few letters in the bin, that is your choice.

Remember that these crooks only survive because they effectively bully some people into paying. If you don't pay, nothing will happen to you. I have given the finger to over 80 fake tickets; nothing has happened to me; and I just laugh at their pathetic drivel.

However, it's your money, and, whilst everyone here will be disappointed, you are entitled to do as you choose.

And echo what Manx says about the injustice of this system. At least think about it for a few days- it is nothing but a con trick.

We know they 'get details from the DVLA', so do all these scammers! So what? For goodness sake it's stated on every thread here and it's being covered yet again by Watchdog tomorrow night!

What do you mean 'LDK were registered to issue tickets' I wonder what you have misunderstood when researching this scam?

No private parking company is 'registered' to issue real parking tickets unless they work for a Council which LDK don't.

And as already said, the BPA is just a trading body, not any sort of authority or regulator! They are an old boys' club for private parking companies, protecting their interests. Their own website is obviously full of spin - how about looking at the wiki page for the BPA which is not as biased:

    http://en.wikipedia.org/wiki/British_Parking_Association

''Operators have been known to issue notices that mimic official Penalty Charge Notices issued by police and local authorities in an attempt to coerce people into paying their penalties. Many operators think they have the legal power to issue fines or penalties as a result of people parking on private land, however this is incorrect and is classed as misrepresentation of authority.''

    and

''Members of the British Parking Association have often had their actions featured on the BBC Consumer Affair's Programme, as well as consumer help websites including MoneySavingExpert.com forums, Pepipoo, Consumer Action Group, among many others.

While the BPA attempt to convey the impression of an official Government Agency to help their members intimidate the public when issuing parking charges, they in fact are merely a members club and have no official or legal standing of any kind. Private parking companies do not have the legal authority to issue fines or penalties, and there is no legal obligation to pay them. Only tickets issued by the Police or Council are legally enforceable. While the BPA itself is a non-profit organisation, their primary aim is to help members make profits.''

How clear do you need that wiki page to be?!

Please don't pay. Only mugs pay, please say you haven't fallen for this scam.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Nina, I know you're scared. Scared is good, sometimes. I wouldn't be alive today, if I hadn't been scared in the past, but that's another story.

If I wanted to, I could issue parking tickets. They also wouldn't be worth the paper they're written on. Literally.

I hereby "fine" you £5 for reading this post. Please leave the cash behind the pillar box in the Co-op car park (it isn't patrolled by a PPC, before anyone says!) in St. Annes Park, Bristol by midnight next Wednesday. If you don't, "Spot", my ginger cat soft toy, "gets it".

So, how much stress did ignoring my "threat" cause? Exactly the same as ignoring the PPC's "threats" will. They are just as legally enforcable. OK, they're better at scaring people than I am. I'd rather not learn how to be, thank you.

A PPC (and me) aren't the local council or police. Only they can impose a fine or penalty. That is the legal "bottom line". It really is as simple as that.

If you want to, when every poison pen letter from them arrives, just come back on here, and we will rip every specific "threat" it contains to shreds.

    We're here for you.

  • My Disabled (blue badge) father parked in a private carpark near the Hartlepool Mail office last week and recieved a ticked from LDK.

They have demanded £90 reduced to £60 (if payed promptly) and increased to £140 after 14 days.

There are further mentions of debt recovery and baliffs involvement.

The reason given on the ticket for its issue is: Parking In Disabled bay.

My father was only parked for 10 minutes and was displaying his blue badge in the window.

Am i safe to just ignore this ticket?

    Thanks
