If the OP was represented by a solicitor in court or advised in advance of the hearing, perhaps he should investigate the possibility of a complaint/claim against the solicitor.

Just a quick update on the situation. I have put an appeal in after speaking to a solicator and they seem to think I have a chance of getting a reduced points penaltly or bigger fine on the grounds of hardship, but this involves letters from my employers and my landlord, apparantly you are allowed one hardship case in your first 3 years driving if you have not had any other convictions. I will let you know how it goes.

I also informed my employer and this was a massive relieve, they also said that without a car I would lose my job but also said that its not as if I have been banned, I just need to book my tests as soon as possible and as long as I get to my appointments it ok.

So as we stand I cannot drive because I am waiting for my appeal to come through. DVLA want to update there site because it says if you appeal the points decision you can drive while you wait for your appeal to come through, well the answer simply is you carn't drive at all until the outcome of the hearing. That is very misleading and something that needs adjusting.

Good luck mate hope it goes your way. I am a driver of under two years i find it strange that even though i passed the same test as other's if you had commited the crime after two years you i would still have be able to drive.
