Hey Davey
I just wanted to wish you lots of luck in getting this issue resolved. I don't know why you are getting such a hard time from some posters, no one likes uninsured drivers but we all mess up and I think you know you're at fault.
I'm pleased to see lots of others offering you great advice.
Maybe don't rush in telling your employers until you have a very clear, very workable conclusion. You are still in your probationary period and could go like a puff of smoke.
Be careful and let us know how you get on.0 -

I wouldn't ever use this word when dealing with banks or insurance co'sproperty.advert wrote: »I pay it all on the day, it is set to auto renew should I "forget", they send you oodles of reminders through the post and by email and only a halfwit could really forget when their insurance comes round.
I pay mine upfront too but that doesn't mean some "halfwit" deep in the bowels of More Than hasn't hit the wrong key on his keyboard!
If you pay by DD, & a lot of people do, you're then reliant on the bank & whoever doing the job properly & my experience tells me that they are sometimes not capable. It happened to me with my council tax but at least I got a letter so I was able to get it sorted.
The OP has admitted his mistake (& paid the penalty) but the point I'm trying to make is that a letter informing him of a missed DD/pending cancellation would have prevented this mess.
I notice that they are saying they sent "letters" but none actually arrived, unless the RM is totally inept I find this a little odd.Always try to be at least half the person your dog thinks you are!0 -
The onus in theses cases is for the prosecution to PROVE that your certificate does not cover you for purposes of the Road traffic act.
If an insurance company "claims" to have cancelled it, the prosecution will be required to produce firm evidence of the notice of cancellation
They must be able to produce a copy of the letter the insurance company claim to have posted, representatives of the insurance company can be called to verify under oath and threat of imprisonment to testify that the letter is genuine and was indeed served.
Case law on this is very detailed and covers several volumes, it exists for a very good reason, to stop insurance companies cancelling your insurance first sign of a claim.
As cases are heard at "guilty courts" Magistrates you will almost certainly have to appeal to the higher court to obtain justice, but once case law is presented as precedent the justice is usually swift.
The public perception that you have no insurance if the insurance company say they cancelled it is a falsehood, it is subject to several tests before it becomes void.
The Insurance company can cancel anything above the road traffic act contractually, but to cancel your cover under the road traffic act is subject to very strict procedures that must stand the burden of unmountable proof.
Hundreds of motorists plead guilty every year for an offence they have not commited and many dozens more have convictions reaped upon them by non legal qualified magistrates.
The appeal success rate is very high in these cases.
This however will not help the OP as he pleaded guilty, which was foolish and now the consequence's are to be seen.Hi, we’ve had to remove your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
Dave, good luck sorting out your troubles. I have nothing to add to the excellent advice already given here (especially the moped, I would go with that one personally).
Just one thing though, start making a habit of checking your bank account balance on a weekly basis at least, it will save you loads of trouble in the future.0 -
If you need your licence that much, consider purchasing this type of insurance http://www.chauffeurplan.com/0

I have a few days so, I should be able to sort something out, I will ask my dad for the local towns but I will need a driver for the week after because I am in Birmingham all week, it is at the same location but I will be staying down there, I could take all my files into the employers on the first day and get a taxi from my hotel and back, so I would just need taking down and bringing back, I would see if I could put a weeks holiday in the following week.
Get the train to Birmingham with a laptop bag minimal files in your overnight bag you should be OK.;)0 -

I've seen quite a few pay outs under it, the customers are always amazed how much they can claim for and how convenient it is just having a chaffeur when they lose their licence or a physical problem stops them driving.
All the Insurance broker bosses I have ever known have always had this cover and it's tax deductable0 -
I would say 4 weeks is tight to apply for and receive your provisional, sit and pass your theory test and then book and pass your practical test.
Good luck anyway!0 -
yes I'm with Swinton and have been since the incidant, Thats my next point of call informing them about my conviction, bearing in mind I have only just been convicted of the offence.
Are Swinton one of those companies who ask if there are any prosecutions pending? If you are querying your Council Tax band would you please state whether you are in England, Scotland or Wales0
