Claiming against bank which does your mortgage (merged)

I am new to the site, so please excuse me if this has come up before. I am about to write to HSBC to claim back illegal charges. I have read that they can close your accounts for spite. I have a mortgage with them as well. Can they force me to move my mortgage and if asked do I have to.

    I'm about to send my letter off asking for all charges to be supplied for the last 6 years, however I'm getting a bit worried as I have a mortgage with RBS. I don't have any overdrafts on my accounts so couldn't care less if they cancel them as have accounts elsewhere but can they cancel my mortgage?

    p.s. I read in another post about them not being able to cancel a loan but nothing about mortgages.
  • I'm about to reclaim my bank charges from the ABBEY but before I do so I'd like the answer to the following query. I have a mortgage with ABBEY (FRANCE) a subsiduary of ABBEY plc. I have heard after some banks settle the debt they sometimes close the account, ABBEY in particular. I have this covered with another bank account, however could they or would they get in touch with ABBEY (FRANCE) and attempt to foreclose on my mortgage as well???

  • I have successfully reclaimed £1,196 from Royal Bank of Scotland for my son but I am reluctant to reclaim my own charges as I have a mortgage with the same bank. Does anyone know if they can demand I repay my mortgage? I have never defaulted on it - the bank charges were for going over my overdraft.

    Your mortgage is a seperate agreement with your bank. No, they shouldn't touch this if you reclaim the charges from your bank account.

  • I'm claiming against HSBC at the mo but am thinking about claiming my charges back from Abbey too, the only problem is that Abbey also do my mortgage and I don't want to run the risk of them suddenly saying that I have to move the mortgage, can they do this? I won't be claiming against the mortgage account but a seperate current account, any ideas???:confused:

    HSBC £2515 incl int claimes, settled on £1998:j

    Abbey - £2995 claimed, offered £1098, accepted as part payment and proceed to next stage, response not satisfactory so currently with Ombudsman:confused:

    Cap 1 - settled on charge difference:j

    Barclaycard - settled on charge difference:j

    MBNA - 1 account settled in full, £993:beer:
    - 2nd account settled on difference:T

    HSBC Visa - no charges amazingly!!:rotfl:

    Household Bank Visa - settled on charge difference:T

    ACE catalogue - settled in full after 1 letter!!!:beer:

    As long as your mortgage payments are up to date, they shouldn't touch it.
  • Title worded a little strangely I know but I know what I meant :D

    Let me explain a little better;

    I have a now dormant current account with Cahoot, on which I have paid lots of charges... But I also have a joint current account and a Mortgage (tied for 3yrs) with Abbey, and I also have current accounts with LloydsTSB (which I am pursueing) and NatWest so plenty of spare bank accounts. Now as I'm sure many of you will know, Cahoot is a subsidury of Abbey National PLC!


    Now the question is: If I pursue Cahoot for my charges back, will it affect my joint account and mortgage with Abbey? Most importantly, I don't want any issues with my mortgage!!! Are the two banks (Cahoot & Abbey) systems completely separate or will they both want rid of me? :eek:

    I am thinking of reclaiming charges off HSBC but am slightly reluctant as i have a mortgage with them. I am out of work due to illness so it is only my husband earning, which means we are unable to get a mortgage elsewhere.

    Is there any chance they can tell us to move our mortgage. It will be a huge claim as they have charged me £125 for most months of the year for 6 years!!
