Advice on refund - I feel scammed

Thank you for reading this. Hopefully someone can advise me if i have any rights here.

My wonderful girlfriend purchaced a pool table for me for Christmas from uksportimports(dot)com. She bought on the 28th Nov and it was delivered on 12th Dec.

We live in a flat and there is really no room for a pool table, something that she did not take into account when buying. I contacted uksportsimports today and was told there is a strict 7 day money back guarantee. This starts from the day after the purchase until 7 working days have passed. This gave me until the 19th to ask to return it.

I explained to them that this was a Christmas present and that there was no way that it could have been returned within the timescale of their money back guarantee. They told me that there was nothing that they could do for me. I then asked for a credit so that i could maybe use the money on something else but was again told that there was nothing that they could do.

I feel scammed. does anyone know if i have any rights at all here? The item was bought online using a VISA Debit card. Any advice would be gratefully recieved.

    in what way have you been scammed?
    the item is a pool table
    it is fit for purpose
    therefore the company have no legal obligation to refund you

    perhaps your girlfriend should think a bit more about what to buy you - the company should not be held responsible for her mistake

    Unless their Website offers some form of money back guarantee you aren't entitled to a refund unfortunately. The distance selling regs only allow for a 7 day money bak guarantee. Even if they allowed 7 days after Christmas you've passed that time limit as well.

    I'd suggest either finding room for it or sell it on eBay.

    SoGA it is 7 days after delivery, but as other have stated the retailer has done nothing wrong, your GF ordered a pool table, a pool table was received. before ordering the description would of given sizes, so their would of been amble time for your GF to see if it would fit the flat.

    All i can say is sell it on ebay if you cant find a way to use it

    Although many companies extend their returns policy for christmas, this is not a legal requirement.

    Under law if ordering by distance (telephone, internet) you have 7 working days (as stated in your own post) in which to notify them of your intent to return goods you have changed your mind about. They are not required to give more than this.

    You could always sell it on ebay or your local paper perhaps?

    a long shot, but ensure that the measurements given online more or less match the actual size. If they're very different, you may be able to return under SoGA - but otherwise it's yours to keep I'm afraid - company have done nothing wrong.

    Look at it from the companies point of view. She asked for a pool table. She paid for a pool table. They delivered the pool table. That's it! Your change of mind isn't their fault. In my opinion it would be unfair to return the table even if you had the legal right to do so, but that has expired, so it's down to you to resolve the problem yourself. You haven't been scammed at all.
