    Stating the bleeding obvious here but this does assume they actually paid with the card, and not just own one!

    (it's not 100% clear in the post...)

    But that only works if there is actually something wrong with the goods purchased I believe - which seems to be the case with ToriMac, tho' isn't the case with the OP of this thread.

    I don't think you can invoke Section 75 if the goods are fine, you just didn't realise they were too big or you have changed your mind ??
    I try not to get too stressed out on the forum. I won't argue, i'll just leave a thread if you don't like what I say. :)

    Section 75 says
    75. — (1) If the debtor under a debtor-creditor-supplier agreement falling within section 12(b) or (c) has, in relation to a transaction financed by the agreement, any claim against the supplier in respect of a misrepresentation or breach of contract, he shall have a like claim against the creditor, who, with the supplier, shall accordingly be jointly and severally liable to the debtor.
    As the contract includes any statutory rights such as right to return for any reason under DSR, refusing to accept a return would be a breach of contract.
