    I would say the exact opposite and even if they supplied that same information in a written form at the time of delivery, it is still in breech of the regulations.

    To me it seems as if the company in question are trying to make out "oh look arent we nice, we have a 7 day money back guarantee" when in reality it is something they must provide, not something they choose to provide out of the kindness of their hearts.

    Lets highlight another part they got wrong:

    The oft quoted 'guidelines' say this but guidelines are well, only guidelines after all. Has anyone taken any online business to Court for not refunding inside 30 days? Discussion point only...not trying to be contentious BTW.

    The requirement for the 30 day refund is stated in the regulations.

    (3) The supplier shall make the reimbursement referred to in paragraph (1) as soon as possible and in any case within a period not exceeding 30 days beginning with the day on which the notice of cancellation was given.


    I would be very surprised if anyone had actually gone down the legal route (other than a letter before action).
    Even though you would almost certainly win (IMO) if the contract was covered by the DSR's, it would probably be easier & quicker to attempt a chargeback or S75 claim.

    It is not just the OFT guidelines which state this.

    DSRs do also.

    Does anyone following this post know whether as per the original question you can claim via your credit card for a purchase you are not happy with? we have been battling with Kitchen Magic who did our kitchen 20 th October. There are a few things were not happy with, including the fact that our tap doesn't work propery, they've left a hole n the wall and the worktop is slightly too short.

    I have wasted so much time calling them, and waiting in for them not to turn up. When someone does turn up they don't have anything they need with them to do the work!

    I am drafting a letter to the managing director but if he is as helpful as the operatios manager who has not returned one call, I don't think we'll get very far!
