Anyone had experience of a company/solicitor doing the work of reclaiming? (merged)

    May I suggest you go to https://www.claimsregulation.co.uk and check that they are authorised to handle this work. Then check thier terms and conditions very very carefully. Only once you are totally satisfied that they are being totally upfront and it is not a complete waste of money to pay someone to do something you can easily do for free should you consider using them at all
    As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • I have today received an unsolicited phone call from a company called BCRS Online.

    They started asking all sorts of questions regarding which bank I was with, how often I had been charged, how long i'd been with the bank etc.

    I said I wasn't happy to give anymore information and asked where they got my number from. They claim they got it from my mobile provider.

    Has anyone else had a call like this?
  • im using bank-smart to reclaim my bank and c/c charges.what a waste of time they are.started in march 07.just recieved a form off them for my c/c charges and it came from the fos.no solicters just doing what i should of done and taking 10% plus interest.steer clear people.ive been a fool.do it yourselfs.

    Before I realised that I could reclaim bank charges myself, a company calld Licit Legal took on my case.

    I paid them £15 per account for the paperwork, for 3 accounts I have, back in July.

    Since then, they sent me an email with the following:

    "On 27 July the Office of Fair Trading announced that a test case on bank charges is being referred to the High Court. The Financial Ombudsman Service has announced that pending the outcome of the case it has put its own work on hold; a similar response is expected from the county courts. This means that where a consumer has made a complaint, independently or through a claims management company, then no further action is likely to be taken on the complaint until the test case is settled. In many cases this will mean the claims management company putting the case on hold until the test case is settled.

    Whatever assurances are given about the speed of Trial, this matter can go all the way through to Europe which means it has to pass through the High Court, the Court of Appeal, the House of Lords and the European Court can easily take 24 months or more."

    Where do I stand with this? Do I just have to sit and wait or can I progress this in any other way?

    I am feling as if I have been conned :(
  • Well, aside from being £45 down, you're probably in the same situation as a lot of people who have had their claims put on hold until after the outcome of the test case. However, it does seem as though some people are still having success, so depending on how much work this firm did for you, you might consider asking for your £45 back and lodging the complaint direct with your bank. Of course, if they had already started the process and done work on your behalf then you might be as well sticking with it and keeping up to date with what happens by checking with the good people on here.

    oh lol licit legal are getting a bad name....sack them hun...write them a letter saying ...ok I think i have no claim ( this is if they are a no win no claim company) thank you for trying...and cut them dead. Get yourself away from them.

    You need to check what your contract says regarding canceling your agreement with them, hopefully it will just be £45 that you loose. You will also need to make sure that your bank supplies no further information to them then you need to start with step one in Martin's article and do the claim yourself.

  • Thanks all - will call and try and see what they have done so far, and maybe consider doing it myself.

    Just wish I had done this before, feel like I am in a worse mess now than before I started the whole process with them!

    Just a quick question - would my own claim be accepted now it has gone to High Court?
  • Yesterday I received a phone call on my mobile (god knows where they got that number from:confused:) from a Company based in Manchester (0161xxxx544) asking if I'd ever incurred charges from my bank and was I aware that I could join the thousands and claim them back. I told the very nice lady that I was currently in the process and that all claims were put on hold until the outcome of the Court hearing, She went on to explain that if I sent them £35 then they guaranteed they would get back 100% of my charges, there was no other fee payable, I asked her why I should pay for a free service, She then stated that all banks were claiming 50% of refunded charges back citing administration fees:eek:. I'm sure if I'd sent the aforementioned £35 I'd never hear from them again.
    I may be wrong be beware of these opportunitists seeing an opportunity to try and cash in.
