Hello, I am currently reclaiming by bank charges through the ombudsman service but today i recieved a phone call from ******** who told me for a one off fee of £49.95 they could take lloyds TSB to court for me and get me the full amount i'm owed (£2300) in 6-10weeks! I just wanted some advice about what to do as i don't want to be conned and ruin any chances of reclaiming my money from the FOS. Please can someone give me any advice?

Go to www.claimsregulation.gov.uk and do a search on that site for that company if they are not on there. Contact claims managemnt and report them as they are acting illegally
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person

I just had a missed call from the same people. I didn't recognise the number so ignored it. When I googled the number, I found this post. Am pleased now I didn't answer, but am wondering how they got my number.

Same thing happened to me. I hate it when randoms phone you!
  • I have now recieved payment of my reclaimed bank charges from licit legal minus their fee of 25% plus vat after it taking nearly 9 months and many phone calls chasing them up i wish i had taken the action myself against the bank and not tried to take the easy option of letting licit legal sort it out for me they advertised that the whole process only takes 3 months what a joke! mind you at least i got it in the end many other people have had their cases put on hold for up to two years.
  • Hi. I registered in March with an online company called Bank Smart to reclaim my bank charges. I have just tried to log on only to find I cannot access their website. Has anyone else registred with them and know what's going on? I'm concerned as they have all my details and will I be able to try again somehow?
  • Hello
I am very new to this and coming to you all in desperation.
Although I have been a long time reader of Martins knowledge, this is my first post, so please pass this on if I have posted incorrectly.
I too registered with Bank-smart in Feb 2007 to collect my bank charges from Abbey, stupidly giving them all my details. By July I had not heard from them so I contacted Abbey to see where my case was up to they stated they had not been requested to supply any details. I immediately advised Abbey that if this company bank-smart.co.uk get in touch not to supply any of my information. I then started the process myself with Abbey of refunding my bank charges. I feel if I woul have done it myself in the first place I would now have had the money as it has been reasonably straight forward, albeit now stopped due to the test case but a least I have rec'd a GWG. I contacted Bank smart immediately to inform them I wished our agreement to cancel.
Then today a bill from bank-smart for £176.00 charges, but they didn't do anything for me as Abbey already confirmed. Please help, I know I have been stupid falling for one of these firms, but its done now. I am already in huge debt so another bill will not help at all.
Where do I stand, does anyone have any advice?
  • You need to check what the agreement was with the company. There is no such thing as "no win, no fee" and you may find that in the small print there is a cancellation fee.

As far as Bank Smart are concerned ask them to provide you with proof that they are registered under the claims management regulations. Tell them until they provide proof that they are registered you will not pay them. When I went to the site at www.claimsregulation.gov.uk and did a search for Bank Smart it came up blank.
As I am not the Pope or legally qualified I may be wrong so feel free to get a second opinion from a qualified person
  • Thank you Stokey 125 and Edinburgh lass for your advice.
I have myself checked on the claimsregulation.gov.uk website and bank-smart are indeed registered with them under a name of symmetric systems Ltd I confirmed wit with their address bank-smart is their trading name. I have made a formal complain to bank-smart but the email keeps bouncing back saying mailbox undeliverable.
So I have then made a complaint to claimsregualtion.gov.uk. As far as I can see on their website the maximum I should be charged is documents rec'd £45. as Abbey confirmed they had not har correspondence from them. Not the £150 plus Vat of processing as there was nothing to process??
Any further advice is greatly appreciated and needed. Do I pay or not? As invoice states charges will be added if payment not rec'd within 14 days.
    Kind regards to you all.
