  • They are regulated so should give her 14 days to withdraw without enforcement of the contract. Any fair company would allow withdrawal later subject to a 'fair assessment of costs incurred to date'. Although this is not in the regulations it is certainly arguable in front of a court. Given that your friend has already gone down the route of using someone else, I guess she would not be too keen on taking this argument either.

    Never pay more than 10% plus vat to any company offering this service they can all be found on the claims regulation website

    I started using that company back at the begining of Feb, before i realised that there were sites like this, but after waiting 2 months ( they still hadnt received statements) I cancelled my agreement with them and decided to do it myself. They were very patronising at that firm and told me i wouldnt be able to get as much for me as they would, also very rude whenever i called them to ask how it was going.
    I have just got a judgment issued against Lloyds for my full amount + interest + costs.
    Also did some homework on that firm, they do not have a registered solicitor working there! so its just normal people like you and i, writing letters ( that we can do ourselves) And charging a fortune to do it!

    Depending how far your friend has got with them she should see if she can cancel her agreement.

    There is a thread already started somewhere. I cancelled my agreement with them and dont plan on giving them a penny!
    I posted the letters that i sent to Company to cancel and to the Bank to make sure they deal only with me.
    Depending how far your claim has got ie: if they havent got the statements yet, they are not going to know how much 25% is!

    Hi after trying endlessly to win back my money on my own almost 4k and being totally ignored I decided to look for further help and I came across these people, they take £125 and 10% on a no win no fee basis. I know these companies are frowned upon on here but just curious whether anyone has had any success?

    I am in the middle or pursuing my own 3 claims, and my OH reckons he is owed "thousands" by Barclays, but he can't be bothered to claim. He said he would just get one of those companies to do it! NOOOO!

    They are just opportunists, there is no reason you can't do it yourself, it's generally not more than just being organised and following them up - but it's really only a few letters and you prob won't even get to court. I would say don't give them £125 and 10% of what is rightly yours when it's only about half an hours work for them. You seem to have done the hard work by adding up your charges and writing to them - don't let them take your glory!

    As you can tell I feel strongly about it! But obviously it's your choice!

    (As I said to OH, let me do it, I only charge 5%!) :D
  • And if you do go to court there are great free sites out there with people who have gone all the way and won who will advise you on all the processes and make sure you win.

    I know I hate to use a company like this and give them a cut but I'm at my wits end with this bank charge stuff I cannot afford MCOL and I dont really understand how to go about the FO. Hopefully this is a reputable company I just thought that also it would be quicker then me doing it alone, I dont want my account closed either.

    And you really think those companies will prevent that? Nothing they do you couldn't do cheaper AND quicker yourself. I have heard so many stories of cowboys jumping on the bandwaggon, making a holy mess of it, not putting in documents in time, delaying processes, not getting you the best deal etc. that it really grieves me when people don't even try to do it themselves.If you do not have the money to file a court claim then by all means use the Financial Ombudsman. Martin has written a detailed account of how to go about it in his article. It really isn't rocket science, and it's for free. Let's face it, you will have to provide any of these companies with the details of your charges etc. first too. You could just as well send them to the FO instead.

    Hi Sam,personally i wouldn't consider using one of these companies,they are only out to help themselves.10% may not sound much, but 10% of £4000 is £400 then add it onto the £125 that's £525,this money would be lost to you,but if you used mcol you would get your costs back.If you read the thread for your bank i'm sure you would find some of the posts on there useful,and if you need any help there are plenty of people who are more than willing to offer support and advice,the board guides are fantastic and thier advice is usually spot on.The Fo is also another route you might consider which once again won't cost you any of your own money.Some banks are paying out the full amount after about 7 weeks.Please read some of the success stories and take heart from the people on there who have got thier money back,i myself have reclaimed just under 4k from rbos.SURELY THAT £525 IS BETTER IN YOUR POCKET THAN SOMEONE WHO YOU DON'T KNOW.GOODLUCK :money:
