I dont know if this will be any help, but this is the letter a solicitor friend of mine drafted on my behalf to get me out of the contract i had signed. However i did receive a response from this letter stating that they are still entitled to 25% of anything i eventually receive from my bank ( i chose to ignore that for now)

Dear Sirs
CANCELLATION OF INSTRUCTIONS
This is confirmation that you are no longer instructed to act on my behalf in the recovery of my bank charges. This is with immediate effect.
Despite phone call after phone call I have been unable to detect you having made any progress in this matter. I consider the inordinate length of time taken and the failure to keep me informed as a breach of contract and/or misrepresentation. I therefore regard any agreement between us as having ended and you are to blame.
I am writing separately to my bank to confirm that I am now representing myself in this matter and I would appreciate if you could also confirm with them that you have been disinstructed.
Yours faithfully0 -
And this is a letter ( also drafted by solicitor) that i sent to my bank. I followed this up with a phone call to ensure that the bank deal only with me.
I havent concluded my claim yet ( have filed with county court stage) But after realising that the company could get over £1000 for just writing a few letters i decided to do it myself. Ands its certainly worth trying to get out of it.

Dear Sirs
CHANGE OF REPRESENTATION
This is to confirm that XXXXX XXXXX Limited do not represent me in the recovery of my bank charges. I enclose a copy letter dated 27 March for your information.
Please ensure you amend your records and that all correspondence in this matter is addressed to me personally at the above address.
Written confirmation that this letter has been received and the required changes carried out would be appreciated. I look forward to hearing from you at your earliest convenience.

it's called Brunel Franklin & Company Limited at conkers
i called their free phone number and they advised me that it's no win no fee. and they have won 100% of their cases.
there sending me s form to sign that they can work on my behalf or something.
they charge 25% + vat for this service.
is it worth doing this? or would it be better doing it myself?
has anyone looked further into the company and found them to be a fraud?
or are they actually ok?
be good to hear back from people.

You should do it yourself, its not difficult to do. Also, do you know how much you are claiming? 25% + vat is almost 30% do you really want to give it up more than a quarter of it to someone for just sending a couple of letters?
With the help of this site its pretty easy to do it yourself.
Good Luck0 -
General consensus is that these companies are sharks and not worth bothering with. If you dont want to go the court route you can always follow the process using the first two template letters and then refer the matter (free) to the Financial Ombudsman for resolution.
Be aware that these companies do not always get your full amount of charges back. Also if you have an overdraft the bank will take any refund against that first, possibly leaving you with very little or nothing and the company you employed will still want their 25% + VAT of the full amount you were refunded. Not just what you were left with.
It just isnt worth paying anyone to do the work you could just as easily do yourself and this site provides help along the way to manage any problems you may come across. Stress does funny things to me too and having had a stroke you would think I would not be capable of doing this myself. I am, that is how easy it is and how much support is available on this site.
Good luck doing it yourself.0 -
Hi there
ive been silly and months ago when i first heard about this signed up witha company to claim back my charges! There only taking a 10% charge so i thougth that was okay. The thing is, i first sent them my letter and they asked bank for statements on the 7th of Feb and i still havent got my statements through and the company are saying they still havent got them. Do you think i am being taken for a fool or do yout hink they still genuinly not recieved them.
Is there any way i can cancel this company from claiming and just do it myself or is there no way of getting out of this, it just seems that im waiting forever.

has anyone used robertson holbrook to reclaim bank charges. i instructed
them in December 2006 and then again in January 17th as they seem to
have lost the paperwork Since then apart from an acknowledgement letter
I have heard nothing. Wrote on the 8th April no response. E-mailed
no response. I am trying to claim from two banks and one building society.
Their telephone line constantly says its operators are busy dealing with
calls, to call back - but that is futile. Has anyone else had the same or
a similar experience. What should I do should I start from the beginning
again myself.0
