  • I am having the same problems with Lloyds! I sent away two claims in October 2011, one for my husband and one for me. My husband received an offer letter on 22nd December and has still not had any money paid! After several calls to them, constantly being told mine was still to be looked at, I found out last week that it has not been looked at as it was linked with my husbands!! No idea why as they were for sole loans! I was told it would be escalated and I would have a reply in 5 days, so I called them yesterday to be told that it will not be 5 days it could be over a month before I get a reply!! They are now in week 13 and I have not had any communication from them, beginning to lose the plot!!:mad:

    Just got of the phone to the FSA Had a part payment from LLOYDS in dec and the rest to follow.Have emailed them and the same excuse will get it sorted ASP. The FSA have told me to put in a offical complaint to the ombusdman so I am just about to do it realy fed up with LLOYDS just fobbing me off

    To which i've just replied with....

    Dear Sir/Madam,

    Thank you for your response.

    I appreciate that Lloyds TSB are busy – that is evident to see from the 152 pages of complaints (all Lloyds TSB customers, and increasing daily!) on a well-known financial internet forum - with people giving their stories saying that they haven’t yet received their payments either! - and some of them have been waiting as far back as last spring. The excessive workload is the problem of Lloyds TSB – not myself. If Lloyds TSB are proving to be this slow, then I suggest that extra staff may be needed to speed up the process….

    When customers owe Lloyds TSB money, they (Lloyds TSBs) are quick enough at sending letters demanding when they will take the money from our accounts – so as this is my money, I am applying the same method. My deadline still stands. This money is not Lloyds TSB’s money – it is mine! If the money has not reached my account by 14th February 2012, I will recover the refunds via court.

    Yes they are busy, however they have already shown that its not in any order that cases are being looked at and resolved - so on that note I imagine that a court claim in place will jump to the top of the pile pretty sharpish.

    Its taking so long to get my payment fully resolved that I may have well started the court action a few months back and could have at least enjoyed firing some pain back in their direction... I believe that when court papers arrive people suddenly realise they are accountable for their actions and can't hide behind the corporate wall.
  • Gringo 2000 that is a fantasic response to them. Fairplay and maybe we should all start doing this. I have had enough and my refund was calculated to the 10th Jan so i can only say how sorry i am for the ones that have been waiting longer. I rang and spoke to some one yesterday that i haven't spoken to before and he was helpful in a sence that he could see that my mother chased on mybehlaf the day before and that a chase had been sent to refunds and that he advised me that the response from them could take 4 weeks. That's when i lost it a little with him. I am aware that it's not their fault but how hard could it be for some one to apply notes onto an internal case on what i would presume would be an internal system??? The whole thing is a joke and as every one on here i am just so fed up with it but may take a leaf out of Gringo 2000's book and if they don't have payment into my account by a date i set for them then i shall be also taking court action!!!!

    If you've recieved a letter with an offer, then that is an admission from Lloyds TSB that they owe you money - therefore, you WILL more than likely win your case. You are legally entitled to your money back within a reasonable timescale (ie, 6 weeks+) - so those of you that are on here are within your rights to demand your money back.

    Just remember the following:

    1. Legally, you cannot use the threat of court action if you don't intend to do so. If you threaten them with court action, you must follow up your threat. You're not allowed to use the threat of court action if you don't intend to as this is regarded as bullying/harrassment tactics.

    2. You can be firm - but polite. If you send them abusive/very threatening emails, your case can be thrown out of court on the grounds of 'bullying'.

    3. You HAVE TO give them at least 14 days notice of your intention of taking them to court, in order to give them time to settle your claim in advance. You can't just take them to court without warning them. Once you've warned them, they have two options.

    A) Pay up by the deadline you've said you'll take action by.
    B) Ignore your warning - and face court action.

    If they decide to go for option B, then the court will have your evidence that they (Lloyds TSB) owe you money - and will order Lloyds TSB to pay up. By this stage though, there will be additional fees - the court costs. Therefore, it costs the bank more money.

    The downside is that you have to pay the court fee upfront yourself - however, this court fee is added to the amount that you are claiming for from Lloyds TSB - so once you win your case, you'll get your court fee back.

    The court fees vary depending on how much they owe you:

    • Up to £300 - £20 Court Fee
    • Up to £500 - £50 Court Fee
    • Up to £1000 - £80 Court Fee
    • Up to £5000 - £110 Court Fee
    You don't need a solicitor either - you can do it yourself.

    Its a fairly quick process - if you go down this route, the court allow 5 days for the claim to reach them in the post, and then give Lloyds TSB a further 14 days to respond to your claim. By which time, they usually pay up.

    If they don't pay up, you can then apply to the court for a "judgement of enforcement" - this then enables bailiffs to go into Lloyds TSB to recover computers/equipment to the value of your claim.

    Note: The above is simply advice about information i've researched so far - if you go down this route, I urge you to do a bit of basic research yourself rather than taking my word for it, however, you'll find that most of it is correct. Just thought i'd get that in incase someone goes in gung-ho and then comes back blaming me ;)

    I am again facing another day of no payment. I am now on day 62 since the date on the offer letter. I emailed th usual departments today but as always no reply. I also emailed Andrea Bay and cc'd my local MP. The mail to Ms Barry bounced stright bck saying incorrect email address (why am I not surprised). I did however receive another email back from my MP. He advised me that he too has emailed Lloyds and they have infact called him. They have told him that they have my details and will be in touch in a couple of days.
    I await with baited breath....;)

    My problem is slightly different.
    Put my claim in dec 11 for a loan in 1997 (5 year loan)
    Received my up held letter last week saying I will be getting 450 quid back I thought that was low so rang them.
    They told me it was for a loan in 1991 (2 year loan that I had forgot about :-)) and they couldn't find my 1997 loan but I have a print out telling me the loan was started in 1997 payed off in 2002 ;-)
    They both have the same account number its the way TSB used to work before 2000 but I kinda think they tried to fob me off with the cheapest claim.
    Went to my branch and the kind lady faxed off a escalation claim form for the 1997 loan.........
    Email sent to my MP about this but he hasn't replied, wont be voting for him again ;-)
    My wife is still waiting for 2 pay outs from them after getting her first payout before she even got her upheld letter lol

    Hi Letter received 12th December interst calculated up till the 05th Jan still no payment
    Multiple emails since then 2 generic replies advising they will be sending out a recalculation letter as they have passed the date but due to a backlog cannot advise how long this will take cannot advise when payment will be received no loan to be restructured only waiting on £7.5K!!!! bills to pay wolves at the doors my money...
    Have emailed my MP but noy holding out he can help with so many of us emailing our MPs surprised there not taking more action
    Love to AB at LLOYDS F*****G TSB will be leaving as soon as payment is received .
    Am I right in believing they only pay at the end of the month so I will have to wait at least till the last wek in Feb
  • Does everyone have a "interest calculated to" date on their letters? My upheld letter (arrived 8th Dec) doesn't have any dates on it about when the interest has been calculated to. Just a "your payment will be processed as quickly as possible" blurb..... obviously thats not all that quickly at all as no sign of it yet...
