Whilst the delay that we are all suffering from is frustrating and tiresome, at least it will be resolved at some time. The legal system is far from the knight in shining armour that some people seem to think it is. You need to pay up front to issue proceedings and it can be a long a drawn out process at times.

Finally, how do you quantify the amount of your loss? Can you rely on the figures so far provided by LTSB? I cannot find my letters at the moment, but I would suspect that there is a 'without prejudice' element to them or even an express statement that their offer is a goodwill gesture. If so, the evidential value of these letters may not be very much if anything at all.
Even once you have submitted your claim, they have 14 days to respond.
If they do respond then it might be timetabled for a trial, if they don't you have to ask for judgment to be entered. Either way this takes time.
Assuming that you manage to get judgment, you then have to ask for the judgment to be enforced, which is a further burden on yourself, and ultimately you might have to ask for the services of bailiffs. Appealing as sending a bunch of heavies round to LTSB might be, it will be a time-consuming and laborious process.
To top things off, the bank might then turn around and say that they are revoking their offer because you have chosen to opt for the civil claim route. It would be cheeky of them, but who knows what depths this lot will slump to.
The point is that there is a lot to think about if you want to sue them. Don't be fooled into thinking that this is simply filling in a few boxes on line. Whilst that may work for some straight forward claims, I am not at all sure that this is the case for these claims.
I would personally recommend simply sitting it out, irritating and down right frustrating as that may be. Apologies if I sound like a first year law student...I'm not!
I think this is the fear people face, it feels strange to action a court claim against anyone - never mind your bank.
However I don't feel the above is that much of a concern. The HMRC run Money Claim Online service IS quick and straightforward to use, if a little daunting at first.
I have used it through work to ensure we have been paid for late invoices others have already written off as bad debts.
From experience the process works every time. Even with the most reluctant of payers.
In short, Lloyds have sent you an offer letter - it explains everything in that they accept you were miss-sold PPI and they now owe you money.
You have figures and standard interest.
You can work out your daily interest to be added.
If you have a follow up letter, it essentially confirms that they know they owe you the money but have not paid it.
You put in a claim, send it to head office along with the references to your case and the amount you are claiming, they get 14 days to respond.
It can't really be ignored and I'm sure you'll get bumped onto a priority list.
The system is provided by HMRC to help people, not stitch them up - unlike the bank which seems to be doing a fine job of getting it round the other way.
The only posts I have seen on here urging caution seem to be in that the bank will use the owed money to repay any outstanding debts you have with them - but I think most of us would happily settle any debts with Lloyds once paid in order to move to a reputable bank that treats their customers not only fairly but well (if you can find one).
The fees are nominal and scaled in relation to the value of your claim by the way. And you can do it all yourself.
If Lloyds started to receive a few of these relating to late payment I think whoever is running this sham will get kicked into touch real fast...

sorry just re-reading the post I quoted... In essence what I'm saying is that from experience when the papers for your court action arrives you get your money PDQ. If they decide to drag you through the courts, I think its pretty clear they had no intention of ever paying up...0

i put my claim in 22nd oct 2010 finally got a letter on the 13th sep 2011 saying we were getting money when i phone get told 4weeks so phone them back get told another 4weeks. Then i get told about a recalulations letter I phone them back 3 times to be told we were missed off the system and should get one within 10 days. Phoned them back after the 10 days still nothing now am on a spread sheet well i take it i will have no christmas. Dont know who to complain to.0

Posts like this at least give me some hope that we're not the only people with no money, no recalcs letter, no apology letter. Nothing but being told we're on a spreadsheet. Guess what Lloyds? You're on a spreadsheet too! My "worlds crappiest banks" spreadsheet and you're in pole position!
In other news; does anyone know if you the FOI rules apply to a bank? I'd love to force a complete and complicated explanation of just how (appallingly) they dealt with our PPI repayments.0 -
