LloydsTSB PPI Payment

Absolutely, from my experience with outsourcing/contracting the service level always drops to keep the cost of using the contractor low. It wouldn't surprise me if you aren't right about the limit. Mind you that doesn,t explain why they are settling the claims out of date order.
I have experience in this department and sometimes the contractors are extremely good, better than the core staff even. They have an incentive in their contract to be fast and are actually penalised for being slow. Some of the people I have known who do this stuff were very well qualified IFA's who because of the recession discovered they could make more doing complaints than financial advice.
My bet, it is not the contractors cocking things up it is Lloyds and the way they have distributed the cases - the contractors will have excluded cases over a certain age to avoid duplication and Lloyds will have lost some files or some such nonsense. One guy somewhere will have just been closing cases on the computer because he can't cope with the workload and it will be found the day before he is fired or day after he leaves with stress.
We suffer, they suffer, the Shareholders and Execs get rich.

Hello,
I am new to this forum and see that I am not the only individual who is frustrated with Lloyds.
I have now been waiting 129 days for my PPI Repayment.
That being said, on the 9th of November, the entire sum, totally several thousand pounds was deposited to my bank account.
The following day, within 24 hours, Lloyds TSB had withdrawn the entire sum.
I was furious when this was discovered.
I have spoken to Lloyds and complained over a dozen times, all to no avail.
It transpires that many individuals received payment on 9th of November. However, Lloyds believed that they had made a mistake and had in fact double paid individuals.
Therefore they assumes that all payees on that day had been double paid and withdraw all funds.
No investigation was completed and all individuals were tarred with the same brush.
There has been no adequate explanation from Lloyds and I have been told that I may not receive the money until after Christmas.
I have voiced my frustration but my concerns have landed on deaf ears.
How Lloyds can withdrawn money and make such a mistake is beyond comprehension.
I would be interested to know, if any other users of this forum are in the same situation.

Can I urge anyone who is considering taking legal action against LTSB to think long and hard about embarking on such a course.
Whilst the delay that we are all suffering from is frustrating and tiresome, at least it will be resolved at some time. The legal system is far from the knight in shining armour that some people seem to think it is. You need to pay up front to issue proceedings and it can be a long a drawn out process at times.
Firstly, who do you sue and where do you ask for the summons to be delivered? is it your local branch or the mob down in Wales, or head office?
You will have to know what to sue them for. Is it breach of contract? Negligence? Mis-representation (fraudulent, negligent or innocent)? Fraud? I don't mean to sound patronising but the answer to this is not straight forward, and it doesn't get any easier. You will then have to evidence why they owe you the money. A simple 'they charged me PPI when they shouldn't have' approach is unlikely to work. You will have to show why this amounts to a breach of contract, etc.
Finally, how do you quantify the amount of your loss? Can you rely on the figures so far provided by LTSB? I cannot find my letters at the moment, but I would suspect that there is a 'without prejudice' element to them or even an express statement that their offer is a goodwill gesture. If so, the evidential value of these letters may not be very much if anything at all.
Even once you have submitted your claim, they have 14 days to respond.
If they do respond then it might be timetabled for a trial, if they don't you have to ask for judgment to be entered. Either way this takes time.
Assuming that you manage to get judgment, you then have to ask for the judgment to be enforced, which is a further burden on yourself, and ultimately you might have to ask for the services of bailiffs. Appealing as sending a bunch of heavies round to LTSB might be, it will be a time-consuming and laborious process.
To top things off, the bank might then turn around and say that they are revoking their offer because you have chosen to opt for the civil claim route. It would be cheeky of them, but who knows what depths this lot will slump to.
The point is that there is a lot to think about if you want to sue them. Don't be fooled into thinking that this is simply filling in a few boxes on line. Whilst that may work for some straight forward claims, I am not at all sure that this is the case for these claims.
I would personally recommend simply sitting it out, irritating and down right frustrating as that may be. Apologies if I sound like a first year law student...I'm not!0 -

And your circumstances are;
We're before you, yet have had no emails or anything. It's not like Lloyds not to work in order; despite telling us on the phone (rudely) "IM NOT INTERESTED IN WHATS BEING SAID ON FORUMS, I'M TELLING YOU THEY ARE BEING PROCESSED IN DATE ORDER" - lies lies and more lies!
Let's wait and see what Friday brings before we speculate on how they are sorting payments, I'm certainly not holding my breath!0 -
