    Anyone know the crucial date from which the increase won't be imposed. Order an upgrade on 9 September - SIM swapped over 17 September. Curios to know if that means I get hit with the increase or not.

  • Seems to me that focussing on 4.3.1 and the existence or otherwise of the CSO may be a red herring (though it would be quite good if it can be said that the CSO does not exist).

    Clause 4.3.1 is an "if" term relating to clause 4.3. All clause 4.3 does is attempt to provide an interpretation of the Ofcom rule that says you can cancel if the contractual change causes a material detriment.

    So if clause 4.3.1 says that clause 4.3 does not apply, that doesn't overrule the Ofcom rules.

    In other words this price increase *is* a change of the terms and conditions. It is not a price rise in line with what you "agreed" by supposedly agreeing to 4.3.1.

    On the other hand if the Terms had said somewhere - "We may increase the monthly call plan charge by the rate of inflation" - then Orange might have been on firmer ground.

    If what you are saying is correct, then matty may be on to something. I'm still not convinced though, although I hope you are right, as I can't afford the rise (low income as self funding full time student with only £80-£90 income a month to pay for uni books, food, clothes, socialising, mobile bill). Although, if I could afford it, I still would be fighting this as a matter of principle.
  • The contract refers to the Charges. The Charges refer to the Price Guide. At the top of the Orange Price Guide it says:

    to suit your needs.
    This price guide tells you all about
    the services available to Orange pay
    monthly customers and shows you
    just how much they cost.

    "Easy to understand costs"? Showing you "just how much they cost"?

    This should be part of any complaint surely.

    Silvercar, Orange Helpers (On Facebook) have mentioned 6th September as the cut off date. Provided you took out a new style price plan not the old one. Even in writing something clearly they have to muddy the waters.

    CSO does seem like a genuine mistake, unlike hiding the term. Though as you say it would be good to say it doesn't exist. I can't find guidance on mistakes in contracts other than signing one by mistake.

    Because I am asset rich and cash poor. My investments are tied in and I cannot access them. The pension I cannot reach till I'm 65. The houses I'm not willing to sell to pay an Orange contract. As it is I reduce my spending to a bare minimum (e.g. less than £400 a year in gas and electricity after discounts and cashback for a 3 bedroom house, £6ish a week on food, £6 on water a month) and am not willing to cut back further. I don't think my credibility is shot because I have made wise decisions in life, and have been lucky. I work incredibly hard (over 80 hours a week between university, voluntary work, and actual work, as well as then 10 hours travel a week). I stand by what I said. I did not say I am a poor student though, you seem to say that. I am someone with very little cash and having to pay £3400 or so in fees a year upfront, which is eating the savings that were able to be accessed (which have dwindled to £200 odd pounds now).

    I made a decision to pay for an Orange contract knowing I could afford the price I paid as the few hours work I do is guaranteed, however they have changed the price, and although I could afford this by eating less than £6 in freshly bought food a week, I would rather not. I think this is understandable.

    And if you think I am silly to put so much in assets and live relatively poorly, that's something I've decided for future security, given a violent family situation. I want to make sure I have my own space and always have enough if need be, even if it would mean reducing costs to a minimum.

    What pray is your interest anyhow in trying to ruining anyone's credibility? It would not negate what I am saying. Seems to be a waste of your time, except for that you seem to enjoy trying to get people's backs up. Grow up.

    I am female, and a mature student, and have worked for many years and saved and given up bedrooms to sleep on the floor to bring money in, I have worked so that I have been up at 6 in the morning and back at midnight, and I have endured trying to escape an arranged marriage.     I would suggest material detriment is more to do with income than wealth, as having to sell assets to bring in enough income to pay for a contract would constitute material detriment, as would having to use limited income to pay more on a phone contract and hence buy less food.
