    Orange are quite clear that they *have* changed the conditions. If they have said "We will increase prices by RPI each year" and made that term clear to everyone, then that would be a different matter, and everyone would have understood it, probably.

    Sorry, Steve, I don't quite get the point you are making. Certainly no one would swap the current situation of a on-off rise of monthly charge below RPI for an annual increase equal to RPI. Or would they? Not me!

    As for Orange being quite clear about changing their conditions - as opposed to increasing the monthly bundle charge - I haven't seen that admission.

    Look - I am not saying that Orange did the right thing - far from it. BY all means, increase the charges for new contracts or when the contract comes to its end. The problem I have with joining the masses in claiming "illegal" is
    (a) that the regulator hasn't taken any action against the networks for the mid-term hike clauses in their contracts declaring them unfair, nor (b) has he acted against Vodafone or Orange for mid-contract increases and
    (c) the one legally qualified comment I have read has been from Which? lawyer who wrote that Orange's action is "probably legal".
    (d) all legal teams from the main networks have incorporated similar increase clauses in their contracts and I find it hard to accept that they ALL have made the same "illegal" insertions.

    I join with everyone in hoping that the decision is overturned. Sure, if OFCOM get some guts and acted or even put out a written statement, then that would help. If any brave person tested it in court is another way or if sufficient customers vote with their feet, then that's another.

    I have warned of the pitfalls of going to another network if they all claim the same right to increase. I am also worried if any members decide to leave Orange without agreement and then find themselves on a Credit Reference site black list.

    Some people have written to Orange and their responses will be welcome, particularly if sufficient use a letter similar to the template. But armchair lawyers are just stoking the fires at present and we need a bit of breathing space to see if any action from the regulator is forthcoming or if Orange decide to back down.

    OfCom will not get involved in individual cases unless you've taken all possible routes through Orange's (in this case) complaint procedure first.

    They also said that they needed complaints if they were to consider taking any action (according to BBC Moneybox). Since the square root of nothing will no doubt happen if you log the complaint in many month's time after exhausting the Orange complaints route and well after the price rise is applied, it would surely do no harm to log a complaint anyway at this early stage with them as per die0u0die's post and get a reference number if they happen to give one out?

    On a different tack and to try to resolve dispute about the legality/illegality of Orange (and Vodafone) increasing their charges and whether this goes against the OIFCOM General conditions, I have raised a complaint to OFCOM about OFCOM themselves and their failure to act to remove the clauses that networks have inserted allowing them to make mid-contract increases overriding the General Condition paragraph 9.6 which gives customers the right to cancel.

    OFCOM have regulatory responsibilities that are above dealing with individual complaints and they have the duty to ensure that the networks have fair terms and conditions.

    Now I don't know if my complaint will be upheld - but one way or another they will need to rule if the terms are fair/illegal or not and hopefully will get them off the fence.

    We shall see.

    If OFCOM ARE saying that they will do nothing without receiving complaints then this makes their existence a mockery .They should be pro-active and watch for such situations and investigate them immediately themselves .

    I've read through the T&Cs and then searched for the terms 'increase', 'RPI' & 'retail' and not got any hits that are in context.

    (I'm on the Dolphin/Animal contract.)

    terminating your Contract because Orange has changed its terms
    4.3 You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment. In such cases you would need to give us at least 14 days written notice prior to your Billing Date (and within one month of us telling you about the changes). However this option does not apply if:
    4.3.1 we have increased the Charges by an amount equal to or less than the percentage increase in the All Items Index of Retail Prices published by the Central Statistical Office in the Monthly Digest of Statistics in any 12 month period; or
