Why don't you ask Orange ?
After all it is they that are implementing the charge increase.
After all some will be getting a benefits increase so they will easily cover their increased mobile use0 -

It is a good idea to look up those laws and cases though so you are more familiar with them than just those sections that I have written.0 -
Mhadf you tell me to stop baiting when I have raised a possible loophole and yet you think it it is okay to be insulted by DUTR? You are entitled to your opinion but it is not one I agree with and I will not put up wi DUTR's bullying tactics.0

i have nicked that one all ready matebut i have changed a bit, as i was asking if they can give me a bit more service or addons for nothing to make up for the rise. & then i said if you can not upgrade me or give me something to sweaten the pot ( sorry i am not to good at spelling
) if not i would leave asap.

While I dont think its been mentioned and to be honest I dont think im going to argue a point with Orange, as Im happy with the service in general, so will just accept the charge increase, but doesnt this add to the points being made?
19 general
changes to your Contract
19.1 Subject to Condition 15, your Contract may be varied or amended only by the express mutual agreement of both parties. A party seeking to rely on such variation or amendment must produce evidence of the other party's agreement to it.
Clearly people are not agreeing with the increase. Im sure I must have missed something as it cant be that clear cut, just didnt know if it helped anyone.

Mhadf, I may be clutching at straws but I think it is worth a go. It may well be that Orange meant the ONS but I would have thought that with all their legal backing they would have made sure that the correct term was used.
I did say in my very first post that the CSO no longer exists but some others kept quoting the section mentioning the CSO as evidence that Orange were entitled to make the increase and others mentioned that Vodaphone had done the same thing. I quoted the appropriate part of Vodaphone's Terms and said they had not mentioned the ONS. The Terms and Conditions are similar but not the same.
The point of a contract is that the terms and conditions are meant to be clear and unambiguous, if Orange are relying on information from an now non-existant Government Agency, I would challenge them on that basis.0 -

The CSO is encompassed into the ONS, I can't post any different to what is posted in the public domain, after all Orange is part of Everything Everywhere , so you mabe grasping at straws or you maybe onto something, only time will tell though.0 -

I'm not sure because I think they will have the contracts we signed (for a lucky few, they've hopefully lost them and will let us out of it) showing that we signed that they are within contract to increase prices less than inflation. They are doing what their contract allows, rather than changing the contract. I believe the crux of the matter is more that just because a contract allows it, does not negate the law that says if a company does raise it (even if allowed) then customers should be given notice and be allowed to leave without penalty.0
