It was not hidden in the T&Cs, it has always been there, if the spare room was not full of junk I could dig out the paper contract from 1994 and scan it for you to see, that clause is written in many a contract for many services, just that it is rarely implemented, with the recession on, you may find lots of companies doing just that.
DUTR, think you'll find lots of T&C's are illegal/invalid. Just because it's written doesn't make it legal. Here's a few hundred cases that will have been past company legal teams and found to be invalid/illegalhttp://www.oft.gov.uk/OFTwork/publications/publication-categories/guidance/unfair-terms-consumer/
And as you have read in this thread, if it's bad for the customer AND not given prominence then it is NOT legally binding. Repeating that it is because it was written doesn't make you right.

I'm not signed to a fixed term price plan either, when the energy prices were announced there was a similar amount of 'hot air' but everybody has cooled down again, it won't be too different with the Orange saga, it will all be forgotten about in a few weeks.
So you got burned in the Energy price rise and want other people to not even bother trying.

Already done. I have no problem with reasoned arguments against an issue but I do have a problem with concerted efforts to hijack a thread by flaming whoever disagrees with you.
Anyway, why can't we just collectively ignore him and try and get the thread back on topic ?0 -

You do seem to have a problem with reasoned argument though
here is the T&Cs again (well a section from it relevant to the thread)
terminating your Contract because Orange has changed its terms
4.3 You may also terminate your Contract if we vary its terms, resulting in an excessive increase in the Charges or changes that alter your rights under this Contract to your detriment. In such cases you would need to give us at least 14 days written notice prior to your Billing Date (and within one month of us telling you about the changes). However this option does not apply if:
4.3.1 we have increased the Charges by an amount equal to or less than the percentage increase in the All Items Index of Retail Prices published by the Central Statistical Office in the Monthly Digest of Statistics in any 12 month period
So whether you want to ignore my posts, will not change the company stance will it?0 -

True, but can I ask you one thing. I have provided lots of reasons and evidence why I believe it to be illegal (included in my template letter on page 24). And I have shown you hundreds of examples of unfair terms being declared illegal/invalid.
Could you do the same for your point please? Just this once show me where the evidence is that hidden detrimental terms are legal? One current English law or regulation would be sufficient. Case laws would be fantastic.
I am genuinely interested as I have struggled to find anything and would appreciate the contrasting points of law.

Not sure where you have shown me hundreds of examples? I'm certainly not going to scour the link. Only time will tell what the outcome of this Orange 'saga' becomes, whichever way it turns out, we will still be the same people will we not?0 -

So not one law, regulation or case to say that hidden terms are legal then, fair enough. I was hoping you might have better luck than me finding one as you seem more determined than I to prove they are valid and legal.
Well the link was there for you, It was to the level above the pdf's, There are 26 bulletin's each with between 30 and 150 pages of cases, each page has between 2 and 4 terms on it. Averaging that out (I'm not going to count them all up) would be a little over 7000 mistakes in terms and conditions provided by companies.
Well we will be a little bit wiser, and one of us will be a little bit more humbled, but yeah the same people
