    Sadly they are, you always get the clique of losers that are looking for a way to worm their way out of a contract, the time it comes round to contract renewal, this little episode will be long forgotten as many will be thinking about that shiny handset for only £xx per month :(

    If this case was quite as cut and dried in orange's favour why all the lies to many callers about the government forcing them to raise there prices lets just stop the flaming and stick with the facts orange are in there rights to raise prices and customers are within there rights to cancel without penalty there is only one way this is going to go before this week is out orange will back down and the increases will only come into play when you upgrade/renew like they should have done from the start instead of the adverse publicity this has given them

    Does anyone not think that Orange would have ran this by their lawyers before implementing it? I'm sure the contract is pretty tight, I don't think Ofcom will have anything to say about it, which is why they are directing all your complaints to Orange, Ofcom don't have any real power to do anything

    Legal teams screw up regularly. Check the OFT for unfair terms that various legal depts will have deemed safe and legal. Also the law can change from when terms were first drafted.
    This term that we are arguing over would appear to have been drafted before 1996, and so before UTCCR was in force or even written.

    I've been in court against bigger and smaller than this with judgements for and against, it doesn't bother me if it goes that far. Documents are already started while I wait for the next response from Orange. Hopefully it's just being over prepared, but time will tell.
  • Got my txt this morning, luckier than most though, my contract is up in February so Ill do my complaining with my feet, Orange coverage in my area is crap anyway and T-Mobile didnt help at all.

    maybe i'm being overly paranoid but the user who claims to have cancelled penalty free only has 3 posts and gives a fairly generic response when asked for information ?

  • I'm surprised there are people willing to change their price plans. When I called they told me I could keep paying exactly the same so it wouldn't be a material detriment.
    Oh, but your inclusive minutes will drop from 600 to 300....but it's ok because it's not very often I use more than 300. I did ask if they could tell me how much extra over the £35 a month it would have cost me 2 months ago when I used 480 odd minutes on the new plan, but she then started back pedalling.

    I've signed a 24 month contract at £35 a month. I expect it to be £35 a month. It's purely and simply the principle of the matter for me.

    Incidentally, I've asked to cancel with no charges, it was refused as expected. I've now sent the letter template from page 24. OFCOM will be next. W do have to try and make a stand over this. If Orange get away with it, the others will follow suit I'm sure.
  • I think I am being fairly realistic about how this is going to go. I have taken advice from ofcom & written to orange asking for either a cancellation of contract or to remain on the same tarrife. If we can't agree I have requested we move to the ombudsman. That is going to cost orange more in admin fees than there going to take off me. In my heart I know I will probably have to pay,in both my head & heart I know I will never give these cowboys another penny at the end of the contract. It heartens me that this thread & many others are still going strong. That shows how angry people are over this issue. An anger & outrage that I think orange have seriously misscalulated. In 18 months time when the orange contract retention tea cant get a soul to resign a contract, then hopefully the idiot who dreamt up this rip off will be led quitly to a job center off there choosing. Orange may very wellhave some very very smart lawyers they have a team of drooling lumatics writing there customer service policies. Yes there call centers may have had enough but so have we.

    They want to change that contract but none of us do. I propose a cancellation of our direct debits. If they want to get the money from me they can then contact me to discuss my concerns over the renege on my previous agreement.

    A few points.

    1. As stated previously, since all of the networks have escalation clauses in their contracts, then presumably they all employ "drooling lunatics" ?

    2. Your plan is a fair one to move matters on and you are realistic about the outcome. Would it not be better for your pocket with less effort and a beneficial outcome to see if you can get a pre-increase discount as a few posters on this thread have done?

    3. If all the networks have the "right" in their contracts to raise prices mid-term, are you really better off going to another network, particularly if Orange offer the best deal at the end of your current contract?

    4. Don't blame the CS team or retentions who have to follow Head Office guidelines.
