    2 Pay the early termination fee and leave orange

    3 Take them to court. Many people on here have said they will do this but until someone's does its all conjecture
  • I would be very surprised if anyone does actually take Orange to court and too be honest everyone who has said they will are more than likely waiting for someone else to take Orange to court to see if they win and if they do then everyone else will jump on the bandwagon.
  • I'm not sure if Kirby is a lawyer, but I just got the following response from Ofcom when I quizzed them directly on the subject of clause 4.3.1:

    29 December 2011


    Dear Mr ----

    Thank you for your further email sent to Ofcom on 22 December 2011.

    Whilst I appreciate Orange has incorrectly referred to the Central Statistical Office which name no longer exists, it is now the Office of National Statistics, this does not mean that the term is not valid. I would recommend continuing with the advice given in my previous email.

    I am sorry I cannot be of further assistance.

    Kirby does not need to be a lawyer, the body is still there, just in another name, why nit pick, take them to court if you believe, don't wait for somebody else to do it, YOU DO IT and become a hero :cool:
  • I think everyone here needs to either accept what Orange have done or take Orange to court it is very obvious that people here can quote clauses all day long and Orange are not going to budge and are just waiting for all this to blow over and no amount of forum chat is going to change their business decision and letters to OFCOM and whoever else are not making a blind bit of difference.

    So if no one will step up and put their money where their mouth is and take Orange to court then this thread may as well be left to die a slow death. I am probably going to get flamed for this but after reading this thread pretty much from the start no one has gotten anywhere and the people who said they will fight Orange in court have yet to do so.

    The cheaper better option is let your feet do the talking! I will not renew with Orange at end of contract as I think a practice of a clause hiding in the small print is underhand. Fixed Contract for a Fixed Price should have been honoured.

    That is the best way really. The contracts people have will end at some point. Simply don't renew with Orange and go elsewhere. Preferably without taking out a lengthy contract. If you go with SIM only at least if prices go up you can up sticks qucikly.

    I think of this a bit like RyanAir. I recall some airport raising its fees for landing so RyanAir just didn't renew with them and went elsewhere.
  • Its a long thread indeed. There would surely have been few who would have read threats from individuals to take Orange to court and taken them seriously? Most will either have taken up whatever revised tariff they were offered when they called customer services (delighting Orange no doubt) or will choose an alternative supplier when their minimum contract term ends (as I will).

    Losing customers is the only thing that would make Orange change their mind or act differently in 12 months' time. In this case it would take months for customer cancellations at contract end to show through (even in the unlikely event that there were enough who felt inclined to "boycott" the network - I don't kid myself that this is the case!).

    My niece got an Orange PAYG at Christmas (annual spend on vouchers £120), which after talking to me is now unlocked and on GiffGaff (O2). Its this sort of revenue loss that isn't obvious to beancounters (or which they probably correctly believe is more than outweighed by the customers paying the extra "inflation-related" increase).

    A financially good move - irrespective of what has happened.
