Argos won't give me my item paid for with gift cards

    I am questioning what right do Argos have to void the gift cards seeing as that contract is now concluded.

    If I buy something in a shop, pay and get the item, they cannot tell me later that they sold me the item in error. Many of the questions we get here (and have an appropriate sticky) is when a sale contract is complete. It's when the offer of payment is accepted and the goods handed over, or dispatched. That is what happened here.

    Why can Argos now say they have the right to void that sale.

    as said before how do we know it is an Argos policy to void the giftcards. the OP was only told this by a store manager. this is why the OP should contact the groups exec. department.

    To clarify - they accepted the cards & gave a reciept as with any other transaction. It was after this the query came up.

    As I understand it a sale contract has been formed.

    I'd still love to know when a contract is formed in an Argos store though.

  • mcbain, I agree with you. In fact there are TWO sales contracts here. Games to gift card, then gift cards + cash to ipad.

    Your store seems to be now voiding BOTH of those, not just one. Very interesting.

    the store manager is disputing the way the giftcards were issued , so therefore voiding the original games - giftcard transaction upon investigation which as its just the word of a store manager how can we know if its true so this is why is it important for the OP to contact the directors office.

    Are they just standard gift vouchers or some gift vouchers specific to when games have been traded in (which may have different terms/conditions)?

    I'm just wondering how this got flagged up by Argos when it came to paying with the vouchers if they are just standard gift vouchers.

    As others have said you need to contact their head office to clarify the situation.
    That term is now no longer valid. Argos have accepted the games and given the vouchers. The game trade is concluded.

    By refusing to honour the vouchers, Argos are at best seeking to back out of the original games trades. They have no other legal basis on which to refuse the vouchers. But if they will not honour the vouchers, they must return OP's original games - or give the OP the cash value of the vouchers.

    a staff member may of recognised the OP from another store and the manager just being cocky thats why the OP should contact argos HQ (exec. office)
