  • I recently used Amazon to purchase a game I required before the Christmas period. I ordered in good time, and the game did not arrive during the delivery estimate date (which I had incidentally taken off of work so I could receive it). I contacted Amazon who told me they were sending it next day recorded and that I could keep the original order if it came. I took a further day off of work to recieve the next day delivery, this also never came. Second time. I informed Amazon that I would like to claim for consequential losses as this was the second such time I had to take a day off of work to wait for the delivery, and they got back to me citing:

    They claim they are not responsible, doesn't the law make them responsible as they entered into a contract with me when accepting my order?

    Sorry no idea, I'm only familiar with UK law, not the laws of luxembourg.

    You took the day off for an item that is letterbox sized?
    If an item was sent 'recorded',then how did you know what day to take off work

    You obviously don't order much from Amazon, I am yet to order a letterbox sized item and have it arrive in a letterbox sized box. Quite often, my items come in boxes 90% larger than the item its self. - Amazon have a reputation for this.

    On the Amazon website, it tells you which day your item will be coming, hence I knew which day I needed to be around.

    After the first failed delivery, I contacted them, and they promised me they were sending one via their Prime Service and that it would come the very next day (I have this in writing), so in light of this, I took the following day off as this is not something the post man will leave if no one is at home, based on the value.

    Surprise surprise, nothing came again.

    I order plenty and have handled more Amazon items than you will ever have ordered.
    Amazon have fairy standard games packaging (assuming its in a standard case) which is letterboxable.

    As for Prime(and I have posted on this many times)
    Its not a next day service.

    If we put your criticisms on weather or not I should have taken a day off for a delivery I was told would be coming on a certain day, let's revert back to my original question... do I have any recourse given that after the first botched attempt, Amazon apologised to me and confirmed that my item would be with me by the end of the day on a certain date, all in writing?

    Already answered - both by Amazon and unholyangel.

    It was Christmas. Delivery delays happen. You could have chosen to have the item delivered to somewhere/someone who would be available to take delivery.

    Won't make you feel any better but an item I ordered from Amazon at lunchtime yesterday was delivered this morning by Amazon Logistics. :)
