    you need to answer the questions but would suggest that you get prof advice to do so, as your answers will be relied on at court

    you also need to fill in the questionnaire and lodge it at court

    how much you claiming? its unusal for an allocation questionnaire to be submitted in a small claims matters especially when you have to pay the fee!!

  • Have to disgagree Mr Bear. Unless the court has ordered the questions to be answered then the claimant need do nothing. Using CPR 18 is just a underhand tactic to confuse non legal people. Be cheeky and make a part 18 request of your own. On your allocation questionairre request under CPR part 18 that the defendant provides you with a full breakdown of their costs icurred bt penanlty charges.

    The court may make you answer some or part of their questions but this will be after both parties AQ's are filed, that will be some time off. Use that time wisely and do some research. The answers to those questions are on this site somewhere.

    The £35 will not be for the transfer to your local court but for the AQ as the fees payable changed on 1st October.

  • Just got my first reply from Mint today having sent a letter last week asking for details of any charges - used the template from here. :)

    Letter does not include details of any charges but says they are 'sorry I am dissatisfied with an aspect of their service....' and that they 'need more time to look into matters further so we can answer your concerns fully...' They stste they will contact me again in 10 business days to let me 'know how we propose to resolve things for you, or at least to let you know how we are progressing'.

    They also include a page on how they will handle my complaint. (10 days option, 8 weeks option and Ombudsman option). Third and last page mentions they are members of Financial Ombudsman Service.

    Now why not send me the charges - it's all computerised so they could have sent it at same time as this letter? Why do they need more time? My initial letter states they have 40 days under DPA as I recall so are they just dragging their feet and wasting time doing all the above?

  • Hi I took on Mint for 800 pounds. Have gone through the usual malarky of them offering a crappy amount (diffrence between 20 and 12), me warning them, then taking them to court, and their lawyers (Corbett) filing a defence using the whole CPR part 18. Sent a letter back saying I didn't have to, only the court can order request for info, and within 2 days, they have come back with an offer of 500 quid.

    Now considering whether to take it any further and how... it can be done!!
  • GMoney et al - any chance of an examplar letter ready to reply to these Corbett defence team - haven;t seen one on site anywhere?

    Still confused as to whether the Ombudsman will refund full charges + interest or only difference between charges and £12???

    Hi been looking now for 1 hour but cant find the address for mint credit card.
    All i have on letters sent from them is the customer services address which is a p.o box.Can someone who has claimed from them please let me know where they sent theres

  • Hi I have been through further correspondence with Corbetts - sending them the standard letter to let them know that I did not have to comply with CPR part 18. They replied with an offer, which I could not accept as it was below what I had asked for. I sent them the standard letter, accepting the offer as a PART offer, but that the full amount was required as per my original request. It's been at least 10 days since that letter was sent and still no reply.. it's now well past the 28 days deadline following my lodging the claim with the small claims court (7th October). Should I let the court know that I have not been satisfied with the response so they are ordered to pay?
