    Yes.

    The Office of Fair Trading’s figure of £12 is still “extravagantly” higher than the cost of automatically administering a late payment and therefore unlawful. All that happens is that the credit card company’s computer adds the charge to your account. You don't even get a standard letter.

    You can use the bank charge letter templates with a little bit of customisation. The credit card companies will try to use the OFT’s ruling as justification that the charges as correct.

    Unfortunately, the Financial Ombudsman will only request the difference between the current £12 charge and any older and higher charges.

    fingers crossed I get all of my charges and interest ONCE Mint have the decency to respond to me asking for a list of ALL my charges applied to the account. To be honest, I can't imagine its that much but why should I just accept their measly offering!!!!

    Meant to have said...............on my OH charges it didn't mention a date the charges were applied to his account, so people out there 'BEAWARE OF THIS'.

    for the purpose of adding interest on to his late fees, I have assumed the first of each month, their fault really for not providing the FULL details I requested.

    Thought I'd update you on my Mint claim :-

    11/6/07 - MCOL claim issued

    14/6/07 - claim acknowledged, they have ticked the box that says they intend to defend all of the claim (no surprise there). By the way it's signed by a trainee solicitor so it's good to see they've got the big boys working on this one. They have 28 days to file a defence.

    This is for a claim that's under £200, it's pathetic posturing really.
  • Hi, I just about to send my second letter to mint. The first one i sen was asking for my statements going back 6 years, the have responded with a letter showing my charges, which amount to £164 and an offer of settlement for £32. needless to say im not accepting it so i now need to know what to do. Is there a template for rejecting the offer? I have found one template but its saying that i have to add together court costs, interest and the difference between their offer and the original amount and state that the costs would be? i have no idea what the court costs would be. Whats the next step? can anyone help? :confused:
  • after reading this thread, it would seem that mint are a very hard company to reclaim from, the seem to be up to all sorts of tricks, i read in one postthat they havent put the dates on as to when the charges were applied, thats what they have done to me too. whats the best way forward?

    I wrote on 7th June claiming £256.44 incl interest and had a reply on 15th June offering me £93.28, I was on hols at the time (courtsey of Natwest charges) so I replied on 25th June rejecting their offer and giving them 14 days or court. I just altered the 2nd template letter from here acknowledging their offer but rejecting it. I haven't heard anything back yet.

    I received a letter this morning saying the offer of £93.28 is the final response and if I am still dissatisfied I can refer it to the Ombudsman, I will be phoning the Ombudsman in the morning

    Got a special delivery letter from them last Friday containing a cheque for £193. That's the whole claim paid up with interest and costs. They say that it would not be financially viable for them to fight it in court. Of course we know and more importantly they know we know that they haven't got a hope in hell of winning.

    I was quite happy to settle for the initial claim on the phone, they said no. They bank on us wimping out at the court stage. After the Hull verdict we are in a stronger position than ever to win. I took them on and it cost them an extra £50.
  • Went through MCOL Claimed £366.60(including interest) + court charges totaling £416.60, claim was acknowledged 5th july, got a cheque for full ammount this morning, Keep at them, Grind the bas##rds DOWN!!!
