All of this is useful info'. I've just sent off the first letter to MINT for 3 late payment penalty charges, albeit only totalling £44. From my experience of being on the other end at BT, I'm not expecting anything other than a fight. But then again, I know the tricks they could try, I've got less to lose than they have and nothing better to do.The acquisition of wealth is no longer the driving force in my life.0

I sent my first letter to MINT on 19 April, giving them 14 days (ie. by 3 May). On 1 May, I received a standard acknowledgement letter, dated 26 April and saying that they "will contact me again" (whatever they actually mean by that) "within the next 10 business days", ie. by 10 May.
I will check my post on 3 May and if I have not received an acceptable response (ie. my charges in full), I will stroll down to the village Post Office with my second letter, giving another 14 days before the county court.
However, 3 May plus 14 days is 17 May, by which time, they should have contacted me as promised. Of course, there is no way of knowing whether this will be acceptable or not.
However, I have worded the last paragraph ...
"Again, I look forward to receiving an acceptable response within 14 days of the date of this letter. If not, please do not doubt that I will commence court proceedings immediately."
... which leaves me free to start court proceedings on 17 May, if they do not reply, or on receipt of an unacceptable response. The acquisition of wealth is no longer the driving force in my life.0 -

Update:
A letter, dated 1 May, arrived today, 4 May. It was the usual standard reply (the logo was even in black & white!), but I have no problem with this under the circumstances: the poor staff dealing with these claims probably don't have enough time to send these, let alone individual replies.
They offered £8.48, which is the difference between my one £20 charge minus the OFT £12, plus interest which I never claimed. The relatively small amount involved in my case makes it easy to refuse this as, if I accepted anything less than the full amount, I would be accepting that the charges are legal.
The next step is evidently the Money Claim Online website, and quickly in order to try and get a head start on MINT's legal department. The acquisition of wealth is no longer the driving force in my life.0 -
I am currently working my way through the MCOL claim form.
Is their registered name MINT or The Royal Bank of Scotland plc?
I've had to use the Southend-on-Sea address as MCOL won't take Scottish ones. However, the fact remains that their registered address is in Edinburgh. Will this create a technical loophole that their legal eagles could try to use to get the claim rejected?
I also have a couple of questions about the particulars template on the MCOL thread.
Firstly, I cannot remember exactly when I opened my account. It was well over 6 years ago, and was as an Access card with Williams & Glyns Bank. They were then taken over by The Royal Bank of Scotland, then my card became an RBS Advanta card and finally a MINT card.
Secondly, for the "date when the money became owed to you" can I put the three dates of the three late payment charges? The acquisition of wealth is no longer the driving force in my life.0
