It doesnt matter if they agree or not, send your letter giving them 14 days to reply before court action, you will eventually get your money, they are just being a bit more stubborn. I have just received £280 back from Halifax despite them acknowledging my claim on Moneyclaim, they wanted to scare me off but it didnt work :T . Good luck
Thanks nickno. Court letter will be sent tomorrow. Fingers crossed i am as lucky as you :rolleyes:0 -
I had a reply back today, i was claiming £280 in charges and theve offered the difference between the £20 i was charged and the current charge of £12 so theve offered a good will payment of £93, anybody any advice please ?0

If you want to continue the process, you should get the full amount.0 -

Hi
I have written to RBS (Mint) requesting £652 in charges back. They have replied offering me £188 which they say is the difference between the amounts I was charged over the years and the £12 that is now charged. They say that this is their first and final offer, and if I dont accept, i should contact the ombudsman.
can anyone tell me if i should do this, or should I just continue with the timetable and send them the '7 day or court' letter?
any advice welcomed!Sealed Pot no 20110 -

Continue with your timetable and send the Letter Before Action, this should give 14 days as per the template.0 -
thanks Nickmack, I thought it was right to stick to the timetable, but wasnt sure when they mentioned the ombudsman.
I have typed the letter now, so will post it at the first opportunity on Tuesday.
thanks for the advice!Sealed Pot no 20110 -
I recently claimed £140 from Mint, not much really compared to other claims but as I had all my statements I thought I'd just add up the charges and send the claim.
They have replied today with the standard letter offering me £42.40. I just called them to decline their offer but mentioned that for the sake of an extra £100 I would be happy to settle i.e. the full amount.
The person who I spoke to wasn't, of course, the person who sent the letter and told me that it was their final offer. I then explained that I would expect them to say that in the hope of putting some poeple off the court stage but I wasn't one of them and wouldn't it make sense for them to cut their losses and pay up rather than be landed with my full claim plus interest and claim costs. He wouldn't budge.
The letter also said that Mint thought their charges are fair, reasonable and transparent so with that in mind I asked him to explain how the £12 charge is apportioned with regard to costs and he blustered about phone calls, letters, the OFT ruling etc.
After I'd pointed out the OFT ruling was merely to establish some consistency across the board and at no time had they ever said it was fair, he admitted that he couldn't tell me how the charges were costed.
So much for transparency!!!!
Here's a question, should I go straight to the court claim, send them the 14 day notice of court action letter or try to phone again and try it on with another person (because you never speak to the same person twice).
Opinions gratefully received.0
