  • Have a great Christmas Susannne. You have learned from your mistakes, are genuinely sorry for what you did, are doing your best to put things right and therefore deserve a fresh start.

Hope life now goes well for you.

You haven't mentioned confiscation. Did the prosecution not ask to start proceedings under the Proceeds of Crime Act 2002?

One of my creditors was Provident and my agent once asked me to take out a loan for her and i refused!(she said she'd pay back with interest and i remember asking her why she couldnt take it out in her OWN name and she never answered me!!!)---NOW I THINK I KNOW WHY!!!!

I guess we all make mistakes.
  • I don't know. This all sounds very quick for our justice system? Maybes it's just me...

Good luck with that. Often far more brutal than the sentencing itself, that will be how Provident get their money back (and how the prosecution will more than likely seek to get a bit of something too).

I hope you have good representation, it already sounds like your barrister has not given you great advice by saying that the only way Provident would get their money back is civilly, POCA is how they will try and get it back and there is no guarantee that they won't try and come after you for the bit you've already paid back.

Once the dust has settled and you have had this meeting you could (if you wanted) make a new profile and post an SOA on the board and people would be able to give you advice on how to move forward. I'm only suggesting a new profile in order for you to be able to move on from this situation because it will be part of your history and personally I wouldn't want it to keep being dragged up.

Although I have no idea what you're facing with all this I wish you the best of luck for the future.

I assume (although don't know) that this will be a date for another Crown Court hearing, there will be various deadlines before then for statements from both sides regarding their respective positions in terms of what the prosecution want to recover and what assets are available to pay back the criminal benefit.
