    As much as I don't support all these people loosing all this money, a blanket statement like this isn't necessary correct.

    Pheonixing a company is something that many people these days do abuse, so fair enough. But it's also a practice that can be used for legitimate reasons whereby the ends maywell justify the means. However, this is always going to be one of those debates that yields many opinions.

    Yes sure, like removing a debt If it a fact as has been reported that you owe over £4 million in unpaid rent and over £450,000 to HMRC
  • hello everyone as you know i got took for £505 by john peters i responded to the oaksolutionshelp.yahoo email and as i was willing to buy my furniture from them i got a quick response i was about to order but the new email add i was told to reply to was [EMAIL="johncussins@yahoo.co.uk"]johncussins@yahoo.co.uk[/EMAIL] the name rang a bell from these threads,, he said as there are over 350 emails waiting on the oaksolution help email it would be best if i emailed him direct BEWARE it is the same man DO NOT give him any details bank/cards ect,, he has told me that the sofa wasnt even ordered cab you beleive this as it was ordered in july so they had problems back then,, i would not trust this man with my house number let alone my bank card number stay well clear off all the companies this family are involved with , he will of course tell us all that they are trying to help as a good will gesture , the best good will gesture would be RETURN MY CASH!!
  • I have had prompt email replies from Oak Contract Solutions. One saying Chinese supplier suspended production. Then a further response saying "that none of the monies you have paid have been received by the company" when I had asked if we could have the sofa we sat on in the store. :mad: I phoned O'Hara and was told to send a copy of my Visa receipt to Oak Contract Solutions. I am very confused by all of this. BUT have been told by Visa provider I am able to make a claim and will be refunded in full. :j
  • I too contacted Oak Contract Solutions who replied

    "Thanks for your mail. We should be able to deliver these goods for you. At this time, we do not have detailed delivery arrangements with suppliers. As soon as we do, we will advise when the goods will arrive. Thanks for your patience"

    I then sent them another email asking if they could refund my deposit and received a phone call from them this morning. The woman I spoke to asked if I wanted to proceed with the order or not and that if I did they would then place the order with the manufacturer but that I would not receive the suite until after xmas now. I didn't know what to do so I said yes as didn't want to loose my deposit (paid on Barclaycard/Egg credit card).

    I have been in contact with Barclaycard and explained that I thought they might be in breach of contract as my original delivery date was anticipated to be 9 weeks from order and that if Oak Contract Solutions now have to place another order it will be a different order number with the manufacturer and therefore not my original order. I also explained that Oak Contract Solutions has one of the same directors and I am lacking in confidence with the situation and just wanted my deposit back as I have found a different supplier that can deliver before xmas.

    Barclaycard are looking into this so I await their advice.

    I then received an email from Oak Contract Solutions in response to my request for a refund

    "This company has not received any money in respect of the deposit you paid and cannot therefore refund it. You need to claim from your card issuer. I have therefore cancelled your order for now. I do need to tell you that they will ask us whether we could have fulfilled this order and we will tell them we offered to. In those circumstances, you may find that they will not refund.


    I completely understand your lack of confidence. It's all very difficult. Sorry..."

    I now don't know what to do? Do I wait and not have any furniture to sit on or order from the new supplier and wait to see if Barclaycard can get my deposit back or just place the order with Oak Contract Solutions and get it after Xmas if they stay in business?

    yes because what people on here do not seem to understand you made your order and paid the money to John Peters who went into liquidation. the so called receivers O'Hara say that all assets were sold to Oak Contract Solutions which is a different company. so OCS do not have your deposits and are under no obligation to fulfil orders placed with John Peters. even though they OCS may have been set up by the same people as John Peters.
  • E mail 1 dated 10th November "I regret to inform you that the Chinese supplier of your goods has suspended production and we do not think we can supply your order. If we are able to deliver, we will contact you again. Sorry..."

    E Mail 2 dated 11th November "I regret that none of the monies you have paid have been received by this company and we cannot therefore use those funds to supply stock. Sorry..."

    The above is the actual wording of the two emails I have received from OCS.

    We too have found another suite that can be delievered before Christmas but do not feel we can purchase this until we actually have our money reimbured by our Visa company. It is all a mess. :(

    That is Boll--- and they know it, it is scare tactics as the new company want your cash.

    I have filled a claim and sent all the paperwork to my CC company I am claiming an anticipatory Breach of Contract under section 75 of the Consumer Credit Act
    As texranger says the contracts were with John Peters and they are is no longer trading. no one else have any responsibility to stump up
    The best advise to all who paid by a Visa Debit card or a Credit Card seems to be leave it to the banks and make a claim to the debit or Credit card company. Visa Debit Cards can claim back under the charge back scheme
    What confuses me if Oak Contract Solutions are saying they received no deposit, (why would they) are they classing these as new orders and will expect you to pay the deposit amount for a second time
