  • Thanks but this is a request to be a Guinea Pig" and I wouldnt feel comfortable dealing to the press and having my name exposed to the public etc. I cant see anything that really helps with a letter in reply to the one I have just received?

    You need to look at the Credit Card Reclaim article:

    It tells you what to do if your Credit Card claim is stayed or compared to the test case. There is a template letter to send in reply.

  • I recently replied to a letter about the test case from Abbey (Cahoot CREDIT CARD) using a template from this forum. They have now sent a letter trying to extend their "investigation" by another 4 weeks.

    The letter says

    "As you know we are currently investigatin your complaint that you raised with Abbey four weeks ago. I am sorry for the delay you are experiencing and I would like to take this opportunity to thank you for your continued patience.

    Our research is taking longer than expected because we want to make sure a full investigation is done. If we are unable to complete our investigation beforehand, we will write to you again in four weeks time to let you know how we are getting on.

    I am sorry that it is taking longer than originally thought and would like to reassure that your complaint is very important to us."

    So what on earth do I do now!! Should I call them and ask if they would consider a settlement before I submit an online claim form - I have done this with Halifax and it worked but Im worried about paying the £80 court charge and then having them say they are waiting for the test case?? Advice grateful??

  • Hi All,

    OK, heres the scenario. I had a cahoot credit card some years ago and decided to claim my charges back several months ago. Letters went back and forth and abbey (who own cahoot) wouldn't budge. The total amount including interest came to nearly £1000 I even offered to settle with them for about £600 before taking them to court.

    I filed on moneyclaim and abbey said they would defend the case. The final date for submitting the defence was 4pm on 20th November (a couple of days ago)

    Today in the post, i get a letter dated the 13th Nov saying that they are willing to offer me £400+ pounds, the amount owing including interest but minus £12 for each charge, which is what is now the permitted.

    In the letter it stated, please call me urgently as the deadline is... But i received the letter after the deadline.

    Had i received it before I still wouldn't have accepted the offer, i've already told them if it goes to court i will only accept the full amount.

    Now. My questions? As the deadline for submitting their defence to the courts has passed, can I automatically claim the full amount?

    What happens next?

    I'm after about £140 from Cahoot which they have charged me in the last 2 months after reading the post about the banks waiting for the courts ruling have I any hope of getting this back and does it need to go through the small claims court if I get that far with them?
    Cahoot doesnt even write to you to let you know that they are charging you all you get is a secure message not even an e mail!:mad:
